<br /> THIS GRANT OF EASEMENT, made and executed this 14th day of
<br /> Jul y , 2009 , by INDIAN RIVER COUNTY, a political subdivision of the State
<br /> of Florida , having a mailing address of 1801 27th Street , Vero Beach , Florida
<br /> 32960 , hereinafter called GRANTOR, to Mt. Zion Missionary Baptist Church
<br /> of Vero Beach , a Florida non profit corporation , whose address is 4405 43rd
<br /> Avenue , Vero Beach , FL 32967 , hereinafter called GRANTEE.

<br /> GRANTOR for and in consideration of the sum of TEN DOLLARS
<br /> ($ 10 . 00) and other valuable consideration , receipt of which is hereby
<br /> acknowledged by these presents does grant, bargain , sell , alien , remise , release ,
<br /> convey , and confirm unto the GRANTEE, its heirs , assigns and successors , a
<br /> perpetual thirty (30) -foot non-exclusive easement for drainage , landscape and
<br /> buffer purposes , which shall run over, across , and beneath the following
<br /> described land , situate in Indian River County , Florida , to-wit:
<br /> See Exhibit "A" attached hereto .
<br /> That GRANTOR dedicates this thirty (30)-foot drainage , buffer and
<br /> landscape easement to GRANTEE is a result of a discrepancy between the legal
<br /> description and the sketch found in the County Deed conveying real property to
<br /> Grantee , recorded in O . R . Book 1842 , Page 2210 . Grantee , its heirs , assigns ,
<br /> and successors , shall be responsible for the perpetual maintenance of the
<br /> easement.
<br /> GRANTOR hereby covenants with said GRANTEE that the GRANTOR is

<br /> good right and lawful authority to convey the easement established hereby and
<br /> will defend the same against the lawful claims of all persons whomsoever.
<br /> Consent of this grant of easement has been joined in the Senior Resource
<br /> Association Inc. , current leaseholder of property described in Exhibit " B "
<br /> attached hereto .
<br /> IN WITNESS WHEREOF , the GRANTOR has caused these presents to
<br /> be executed in its name by its Board of County Commissioners , acting by the
<br /> Chairman of said Board , the day and year aforesaid .
