APPROVAL OF LEASE TRANSFER <br />THIS APPROVAL OF LEASE TRANSFER is dated as <br />between Betty M. Nobles, having a business address of 181 <br />Florida 32960, as assignee/transferee under that certain Lease <br />that bears an effective date of August 1, 2007 ("Lease") <br />Commissioners of Indian River County ("County"). <br />BACKGROUND RECITALS: <br />,a c <br />Q o c? &' — 4 6 a..� <br />of August 19, 2008 by and <br />11 27th Street, Vero Beach, <br />and Concession Agreement <br />and the Board of County <br />1. Effective August 1, 2007, the County and Capcan, Inc. as tenant entered into the Lease. <br />2. Paragraph 5.4 of Lease sets forth detailed provisions for a transfer or assignment of the <br />Lease. <br />3, On August 19, 2008, the Board of County Commissioners, during a regularly scheduled <br />Board meeting, approved the transfer of the Lease to Betty M. Nobles per agenda item 12C1. <br />NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency <br />of which is hereby acknowledged, the County and Betty M. Nobles agrees as follows: <br />1. The County hereby approves the transfer of the Lease to Betty M. Nobles as <br />assignee and successor Tenant. <br />2. Betty M. Nobles acknowledges and agrees that she is a permitted transferee under <br />the Lease and that, from and after the effective date of this transfer, all references <br />in the Lease to "Tenant" shall be deemed to mean Betty M. Nobles. <br />3. Betty M. Nobles acknowledges receipt of a complete copy of the Lease, attached <br />hereto as Exhibit A, and agrees to be bound as Tenant to all of the terms and <br />conditions therein; and further expressly acknowledges and agrees that there are <br />no changes to any Lease provisions in connection with this transfer other than the <br />identity of Tenant. <br />4.
