3 . The first sentence of Paragraph 8 . B . ( 1 ) of the Resolution Agreement is modified to substitute 900 days (November 29 , 2004) for 365 days . 4 . The first sentence of Paragraph 8 . B . (2) of the Resolution Agreement is modified to substitute 910 days (December 09 , 2004) for 730 days . 5 . Respondent acknowledged but waives its right to an administrative hearing afforded by Sections 120 . 569 and 120 . 57 , Florida Statutes , on the terms of this Modification . Respondent acknowledges its right to appeal the terms of this Modification pursuant to Section 120 . 68 , Florida Statutes , but waives that right upon signing this Modification . 6 . Persons who are not parties to this Modification but whose substantial interests are affected by this Modification have a right, pursuant to Sections 120 . 569 and 120 . 57 , Florida Statutes , to petition for an administrative hearing on it . The Petition must contain the information set forth below and must be filed (received) at the Department ' s Office of General Counsel , 3900 Commonwealth Boulevard , MS #35 , Tallahassee , Florida 32399-3000 , within 21 days of receipt of this notice . A copy of the Petition must also be mailed at the time of filing to the Central District Office at the following address : 3319 Maguire Boulevard , Suite 232 , Orlando , Florida 32803 -3767 . Failure to file a petition within the 21 days constitutes a waiver of any right such person has to an administrative hearing pursuant to Sections 120 . 569 and 120 . 57 , Florida Statutes .
