Improvement Fund have conveyed to the Owners the land <br />• <br />described in paragraph 2 above, and itrtis��1agreed that <br />any and all commitments and obligations of this agree- <br />ment, one party to the other, are completely dependent <br />upon, the approval and conveyance, in toto, by the Trustees <br />of the land described in paragraph 2 above, In the event <br />of the failure of the Owners as a result of this applica7 <br />tion to receive said land for a sum acceptable to the <br />Owners and exercised within six months from the date of <br />filing said application, then in that event this agreement <br />shallte null and void. All conveyances from the Owners <br />to the County, and from the County to Sebastian, shall be <br />made without monetary consideration, and shall be made pursuant <br />to and in consideration of the mutual premises and conditions. <br />as contained herein. The conveyances made herein as between the <br />parties shall be subject to any and all rights existing in <br />that certain lease in favor of one HENRY THOMPSON from the <br />Trustees, which lease expires in 1965. <br />10. Sebastian and the County agree that the Owners will <br />be permitted to enter upon, over and through the property and <br />right-of-ways conveyed, in a reasonable manner for the purpose <br />of filling or developing the property of the owners in Govern- <br />ment Lots 3 and ++,.and on that part of the .sandspit itself <br />owned by the Owners, without cost to either Sebastian or the <br />County; provided, such development program does not damage the <br />rights of Sebastian and/or the County. <br />11. Made a part herein by reference thereto for the <br />purpose of clarity in defining the several descriptions as,sat <br />forth herein, is a map prepared by B© Ho MASHBURN, Vero Beach <br />Florida, dated June 16, <br />1964, and marked EX,HIBIT "A" . <br />IN WITNESS WHEREOF, the parties hereto have caused <br />these presents to be executed in their names, and their <br />COUNTY: <br />SEBASTIAN <br />-_x <br />au�!� U °Pu[ <br />C <br />OWNL kS : <br />9 <br />
