C� ) � - , <br /> � � �►L AMENDMENTOWL <br /> THIS AMENDMENT TO COST SHARE GRANT CONTRACT ("Amendment') is entered into thisdq <br /> 6th day of Apri 1 2004 (" Effective Date") , by and between INDIAN RIVER COUNTY <br /> BOARD OF COUNTY COMMISSIONERS , having an address of 1840 25'h Street, Vero Beach , Florida <br /> 32960 ("COUNTY") and Parker Davis Custom Herbicide Applicators , Inc. , having an address of 15901 <br /> Orange Avenue Fort Pierce , FL 34945 (" Recipient") . <br /> BACKGROUND RECITALS <br /> A . On November 18, 2003 , COUNTY and Recipient entered into a Cost Share Grant Contract <br /> ("Contract') for the purpose of partially funding and fully implementing the agricultural water quality best <br /> management practices (" BMP") contemplated in the Contractual Services Agreement with the Florida <br /> Department of Agriculture and Consumer Services ("Department") for the Indian River Citrus Area Water <br /> Quality/Quantity Protection Program , [Contract FDACS #6800] ("Cost Share Agreement") and more <br /> specifically set forth in the Operation and Maintenance Plan and the Applicant Evaluation Review Sheet <br /> attached to the Contract as Exhibit B . <br /> B . The Cost Share Agreement allows for modification to the "Cost Share" portion of Exhibit B <br /> of the Cost Share Grant Contract . <br /> NOW THEREFORE , for good and valuable consideration , the receipt and sufficiency of which is <br /> hereby acknowledged , the parties hereto, intending to be legally bound , covenant and agree to amend <br /> the Contract as follows : <br /> 1 . From and after the Effective Date of this Amendment, the Applicant Evaluation Review Sheet portion <br /> of Exhibit B to the Contract is amended by adding Exhibit B — 1 , bearing a date of December, 2003 , that <br /> is attached to this Agreement. <br /> 2 . All terms and provisions of the Contract not amended by this Amendment shall be and remain in full <br /> force and effect. <br /> 3 .
