<br /> Village Walk South of Vero Beach , LLC , a Florida limited liability
<br /> company ( MORTGAGOR) , by Mortgage and Security Agreement and Assignment of
<br /> Rents , Leases and Profits bearing the 1st day of April , 2002 , and recorded in O . R. Book
<br /> 1480 , Page 2106 , and O . R. Book 1480 , Page 2133 , respectively, of the Public Records of
<br /> Indian River County, Florida , mortgaged unto Benjamin O . Benham (MORTGAGEE ) , the
<br /> premises described , to secure the payment of the sum of One Million Two Hundred and
<br /> No/100 Dollars with interest as therein mentioned ;
<br /> AND WHEREAS , the said MORTGAGOR has requested the said
<br /> MORTGAGEE to release the premises hereinafter described , being part of said
<br /> mortgaged premises , from the lien and operation of said Mortgage ;
<br /> NOW , THEREFORE , KNOW YE , that the said MORTGAGEE , in
<br /> consideration of the premises and of the sum of ONE DOLLAR to it paid by the said
<br /> MORTGAGOR at the time of the execution hereof, the receipt whereof is hereby
<br /> acknowledged , does remise , release , quitclaim , exonerate , and discharge from the lien
<br /> and operation of said mortgage unto the said MORTGAGOR and its heirs and assigns , all
<br /> that piece , parcel , or tract of land , being a part of the premises conveyed by said
<br /> mortgage , to-wit:
<br /> SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF
<br /> TO HAVE AND TO HOLD the same with the appurtenances , unto the said
<br /> rn MORTGAGOR its heirs and assigns forever, free , exonerated , and discharged of and
<br /> 3z from the lien of said mortgage , and every part thereof; provided always , nevertheless , that
<br /> oo nothing herein contained shall in anywise impair, alter, or diminish the effect, lien , or
<br /> ! z ut encumbrance of the aforesaid Mortgage on the remaining part of said mortgaged
<br /> Spremises not hereby released therefrom , or any of the rights and remedies of the holder
