product development, undertaken in Indian River County and other contributions the Project <br /> has made, to the Indian River County economy, and <br /> (7) Reaffirmation by the Closing Fund Awardee's Board of Directors <br /> of its commitments to undertake all research, design, development, and engineering work <br /> related to the Project, except those which cannot reasonably be performed in Indian River <br /> County, at the facilities in Indian River County. <br /> (g) Extension Option. The Closing Fund Awardee may make a one time <br /> election to extend the job creation and investment Measurement Dates specified in Paragraph <br /> 5.0 (c), (d), (e), and (f) by one or two years. This election must be communicated to County in <br /> writing. Exercising this option shall result in a one year, or two year, extension of the terms of <br /> each of the performance requirements, sanctions, and the terms of the agreement. If a two year <br /> extension is exercised an additional year of interest may be levied on any penalties that accrue <br /> to the Closing Fund Awardee after the initial extended performance date. <br /> (h) Matrix. These Award Conditions, as outlined in Paragraphs 5.0 (a), (b), <br /> (c), (d), and (e) and Performance Conditions outlined in paragraph 5.0 (f) above, are <br /> summarized in a matrix format in Exhibit C to this Agreement. <br /> 6.0 NOTICES: All notices pertaining to this Agreement are in effect upon receipt by <br /> a party, shall be in writing and shall be transmitted either by United States Post Office, return <br /> receipt requested; or, overnight express mail delivery . E-mail, personal hand delivery and <br /> facsimile transmission may be used if the notice is also transmitted by one of the preceding <br /> forms of delivery .
