wide reclaimed water main, a 0 . 100 MGD AADF permitted disposal capacity rapid-rate restricted <br /> public access infiltration basin system (R003 ) consisting of three (3) on-site percolation ponds and <br /> a 4 . 0 MGD AADF permitted surface water discharge (D001 ) to the Lateral " D " Canal (Class IV <br /> fresh waters) , thence approximately 2 miles to Main Canal (Class III fresh waters) , thence <br /> approximately 7 . 5 miles to the Indian River Lagoon at Vero Beach (Class III marine waters , <br /> which are not OFW) . The Facility is located at 8405 8' Street, Vero Beach , Indian River County , <br /> Florida , Latitude 27 ° 36 ' 47 " North , Longitude 80° 30 ' 29 " West . <br /> 4 , The Department finds that the Respondent operates the Facility under Department <br /> Permit No . FL0041637 , which expired on July 22 , 2004 . The Department received an application <br /> for permit renewal on February 3 , 2004 . The application for permit renewal was not submitted in <br /> a timely manner as addressed in Rule 62-620 . 335 , F . A . C . , and the Respondent is currently <br /> operating the Facility without a valid permit . The Department has issued five (5 ) Requests for <br /> Additional Information (RAI) to process the application for permit renewal . On March 17 , 2004 , <br /> Department personnel conducted a file review that indicated the Facility had exceeded permitted <br /> limits . <br /> 5 . On May 17 , 2004 , the Department issued a Warning Letter , attached as Exhibit 1 , <br /> to the Respondent for exceeding permitted limits . <br /> 6 . On July 15 , 2004 , a meeting between the Department and the Respondent was held <br /> to discuss the issues addressed in the Warning Letter , In a letter dated July 27 , 2004 <br />, the <br /> Respondent agreed to enter a Resolution Agreement and requested that the Department reduce the <br /> penalties that were presented at the meeting . <br /> 7 . Having reached a resolution of the matter the Department and the Respondent <br /> mutually agree and it is <br /> ORDERED : <br /> 8 . As of the effective date of this Resolution Agreement the Respondent has not been <br /> issued a wastewater permit by the Department . A wastewater permit for operation of the Facility <br /> is required pursuant to 403 . 087 and 403 . 088 , Florida Statutes , and Chapters 62-4 and 62-620 , <br /> 2 of 11 OGC File No . 04- 1977 <br />
