REYES, the address of which is 6615110'' Street, Vero Beach, Florida (hereinafter the <br /> DEVELOPER) is effective upon execution by the second of the two parties . <br /> WHEREAS , the DEVELOPER, in conjunction with the construction improvements at Reyes Duplex, is <br /> providing wastewater facilities to serve the subject property located at 6615 1101' Street, Vero Beach, Florida <br /> and more specifically described in Exhibit "A"; and <br /> WHEREAS , the DEVELOPER, was initially required to construct a privately owned lift station and force <br /> main to connect to the County sewer collection system and where it would benefit other area residents along <br /> 110`h Street by having a gravity sewer system available . And where it would benefit the community and the <br /> Developer to construct a gravity sewer collection system to service all parties ' needs . <br /> WHEREAS , the COUNTY ' S financial share of the proposed gravity sewer will be reimbursed over time <br /> as other residents connect to the sewer system. <br /> WHEREAS , pursuant to Section 918 . 05 , The Code of Indian River County (Ordinance 90 - 16, as <br /> amended), the COUNTY requires the DEVELOPER to provide the utility improvements to serve the regional <br /> area, and agrees to reimburse the DEVELOPER, as provided herein, for the cost of providing these off-site <br /> utilities , <br /> NOW, THEREFORE, for and in consideration of the mutual promises set forth herein and other good and <br /> valuable consideration, the COUNTY and DEVELOPER agree as follows : <br /> 1 . OFF- SITE UTILITIES : <br /> The DEVELOPER shall construct the necessary off-site utilities described herein as directed by the Indian <br /> River County Utilities Department. The COUNTY shall reimburse the DEVELOPER for installation of an <br /> offsite gravity sewer system as outlined below : <br /> A . _6-inch & 8 -inch Diameter Gravity Sewer System along east side of US Highway # 1 to the beginning of <br /> 110`h St. <br /> The DEVELOPER shall furnish and install a gravity sewer system along the east side US Highway # I <br /> to the intersection of I I 01 Street. The gravity sewer system will consist of approximately 456-lineal <br /> feet of 8 -inch PVC gravity sewer, three (3 ) sanitary manholes, 60-lineal feet of 6 -inch PE gravity <br /> sewer and making connection to an existing sewage lift station located on 110"' Place and US <br /> Highway # 1 .
