SD -02 -06 -11 -CFC (2002020080 -33766) <br /> THIS MODIFICATION , made and entered into this 6th day of <br /> Apri 1 , 20047 by and between # JDC Florida , Inc . , an Alabama <br /> corporation authorized to do business in the State of Florida , hereinafter <br /> referred to as " Developer ' , and INDIAN RIVER COUNTY , a political subdivision <br /> of the State of Florida , by and through its Board of County Commissioners , <br /> hereinafter referred to as " County" . <br /> WITNESSETH : <br /> WHEREAS , Developer entered into a Contract for Construction of <br /> Required Improvements No . SD -02 - 06 - 11 -CFC (2002020080-33766 ) <br /> guaranteeing the completion of certain required improvements within Riverwind <br /> Subdivision Phase One by April 15 , 2004 ; and <br /> WHEREAS , those certain required improvements were guaranteed by a <br /> surety bond ; and <br /> WHEREAS , certain of the required improvements have been completed <br /> and Developer wishes to reduce the amount of the bond and substitute cash for <br /> the remainder of the required improvements not yet completed ; and <br /> WHEREAS , Developer has posted $ 21 , 133 . 55 cash and has entered into <br /> a Cash Deposit and Escrow Agreement , attached as Exhibit "A" in support of the <br /> contract and modification ; and <br /> NOW, THEREFORE , IN CONSIDERATION OF THE MUTUAL <br /> COVENANTS AND PROMISES HEREIN CONTAINED , the parties agree as <br /> follows : <br /> 1 . The amount of the bond is reduced to $ 21 , 133 . 55 , with the <br /> required improvements not yet constructed itemized on Exhibit " B " attached <br /> hereto . <br /> 2 . The surety bond is substituted with cash in the amount of <br /> $ 21 , 133 . 55 , and Developer has executed a Cash Deposit and Escrow <br /> Agreement , attached as Exhibit "A" hereto , in support of the Contract and <br /> Modification . <br /> 2 , The Cash Deposit and Escrow Agreement is made a part of this <br /> Modification . <br />
