County Approval Required : This Agreement is subject to approval by the Indian River <br /> County as set forth in paragraph 2 . <br /> 8 . 10 Beneficial Interest Disclosure : In the event Seller is a partnership , limited partnership, <br /> corporation, trust, or any form of representative capacity whatsoever for others , Seller shall provide a <br /> fully completed, executed, and sworn beneficial interest disclosure statement in the form attached to <br /> this Agreement as an exhibit that complies iwith all of the provisions of Florida Statutes Section <br /> 286 . 23 prior to approval of this Agreement by the County. However, pursuant to Florida Statutes <br /> Section 286 . 23 (3 ) (a) , the beneficial interest lin any entity registered with the Federal Securities and <br /> Exchange Commission , or registered pursuant to Chapter 517 , Florida Statutes , whose interest is for <br /> sale to the general public , is exempt from disclosure ; and where the Seller is a non-public entity, that <br /> Seller is not required to disclose persons or entities holding less than five (5 %) percent of the <br /> beneficial interest in Seller. <br /> 9 , Additional Terms and Conditions ,• <br /> 9 . 1 In addition to the personal property and equipment to be removed, pursuant to paragraph 6 . 1 <br /> (b) of this Agreement, the Seller acknowledges and agrees that the closing shall not occur until that <br /> certain mobile home unit, located on the Property, has had any and all tenants and tenancies ended at <br /> least one ( 1 ) business day prior to the Closing Date. <br /> 9 . 2 The County reserves the right to inspect the Property on the day prior to the Closing Date . <br /> 9 . 3 The County guarantees to the record owners of the North 1/2 of Lot 4, Block 3 , PALM <br /> GARDENS the continued use of the well as specified in the warranty deed dated 1 /22/96 and <br /> recorded in OR Book 1092 Page 0957 . If, at, the time of actual road construction , the well must be <br /> capped (rendered unusable) , the County, at its sole expense, will install a well similar to the existing <br /> well, on the North 1/2 of Lot 4, Block 3 , PALM GARDENS . <br /> 9 . 4 The Seller agrees that the Seller shall laccomplish the formal eviction of any and all tenants , <br /> whether or not in possession at the Closing Date, in accordance with Florida Statutes , at least one ( 1 ) <br /> business day prior to the Closing Date . <br /> Standard Agreement to Purchase and Sell 4 <br /> Real Estate — Florence Sabonjohn, Individually and as Trustee <br />
