Bid Security must be in the sum of not less than Five Percent ( 5%) of the total amount of the bid , made payable to Indian River County Board of County Commissioners . In the event the Contract is awarded to the Bidder, Bidder will enter into a Contract with the County and furnish the required 100% Performance Bond and 100% Payment Bond within the timeframe set by the County . If Bidder fails to do so , the Bid Security shall retained by the County as liquidated damages and not as a penalty. The County reserves the right to delay awarding of the Contract for a period of sixty 60 days after the bid opening , to waive informalities in any bid , or reject any or all bids in whole or in part with or without cause , or to accept the bid that, in its judgment, will serve the best interest of Indian River County, Florida .
