RESOLUTION <br />NO. 66-22 <br />WHEREAS, there is pending in the Circuit Court of the <br />Ninth Judicial Circuit of Florida in and for Indian River County, <br />case number 70, entitled Erdle & Wilder Aircraft, Inc., in its <br />own behalf and in behalf of Peerless Insurance Company, Plaintiff, <br />vs. Indian River County, a political subdivision of the State of <br />Florida, et al., Defendants, wherein the Plaintiff is seeking <br />damages in the sum of $16,885.00 from Defendants for the destruction <br />of an airplane owned by Erdle & Wilder Aircraft, Inc,, and insured <br />by Peerless Insurance Company and operated by one Robert Spillman <br />at the time of its destruction; and, <br />WHEREAS, another Defendant in said case has paid $4,000.00 <br />to Plaintiff for a stipulation dismissing it as a Defendant in the <br />case, thereby leaving the sum of $12,885.00 actually in controversy; <br />and, <br />WHEREAS, Plaintiff has offered to settle said case against <br />Indian River County and to stipulate for the dismissal of Indian <br />River County as a Defendant in said case for the sum of $4,000.00; <br />and, <br />WHEREAS, Gould, Cooksey & Fennell, attorneys employed by <br />Indian River County to defend it in said case, have advised the <br />Board of County Commissioners that, in their opinion, said settle- <br />ment offer should be accepted, a copy of said law firmts opinion <br />being included in these minutes, NOW, THEREFORE: <br />BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida, that Indian River County accept the offer of <br />Erdle & Wilder Aircraft, Inc., in its own behalf and in behalf of <br />Peerless Insurance Company, to settle said case against Indian <br />River County for the sum of $4,000.00; <br />MAY 11 to 9 PAGE801 <br />
