JOHNS RIVER WATER MANAGEMENT DISTRICT <br /> AND INDIAN RIVER COUNTY <br /> FOR THE SEDIMENT, FLOW REDUCTION & OTHER WATER QUALITY IMPROVEMENTS <br /> WITHIN THE INDIAN RIVER FARMS WATER CONTROL DISTRICT <br /> THIS AMENDMENT is entered into this �� day of , 2003 , by and between the <br /> GOVERNING BOARD of the ST. JOHNS RIVER WATER MANAGEMENT DI CT ("DISTRICT") , whose <br /> mailing address is Post Office Box 1429 , Palatka, Florida 32178- 1429 and INDIAN RIVER COUNTY <br /> ("COUNTY"), whose address is 1840 25th Street, Suite N- 158 , Vero Beach, FL 32960-3365 . <br /> WHEREAS , DISTRICT and COUNTY entered into an Agreement on January 15 , 2002, to for the <br /> development of a Master Stormwater Plan . <br /> WHEREAS , DISTRICT and COUNTY desire to modify the Agreement. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein and for other good and <br /> valuable consideration, DISTRICT and COUNTY hereby agree to the following amendments : <br /> 1 . ARTICLE I - TERM: delete this paragraph and replace it with the following paragraph: <br /> "A . The term of this MOU shall be amended in its entirety to read as follows : The term of <br /> this MOU shall commence on the effective date , January 15 , 2002 and shall terminate <br /> on January 15 , 2006 . " <br /> 2, ARTICLE II — PROJECT IDENTIFICATIONAMPLEMENTATION : delete this paragraph and <br /> replace with the following : <br /> "From and after the effective date of this Amendment, Exhibit "A" consisting of pages A- 1 through and <br /> including A-3 is amended in its entirety by replacing the Original Exhibit "A" with Exhibit "A- 1 " attached. <br /> From and after the effective date of this Amendment, the Original Exhibit "A" shall have no further force <br /> and effect." <br /> 3 . ARTICLE III — COUNTY's RESPONSIBILITIES : Paragraph 5 , add the following : <br /> Each invoice shall be submitted in detail sufficient for a proper pre-audit and post-audit review and shall <br /> comply with the document requirements described in Comptroller Memorandum, dated October 7 , <br /> 1997 , attached hereto and made a part hereof as EXHIBIT ` B " to this agreement. <br /> 4 . ARTICLE VI — GENERAL <br /> Add the following as Paragraph 13 : <br /> The DISTRICT and COUNTY may make changes in the service, work or funding to be provided within the <br /> MOU by mutual written agreement in the form of an amendment. <br /> 1 <br />
