7.0 The responsibilities listed in this section are to be provided at no charge to <br /> Government of Thomas Penders & Associates. Thomas Penders & Associates performance is <br /> Indian River predicated upon the following responsibilities being fulfilled by Sunbeam <br /> County Properties, Inc: <br /> Responsibilities <br /> Government of Indian River County will designate a Contact Person to whom all <br /> Thomas Penders & Associates communications will be addressed and who has <br /> the authority to act for Government of Indian River County in all aspects of this <br /> SOW. This person will communicate project status with Government of Indian <br /> River County personnel and provide timely response to Thomas Penders & <br /> Associates requests, questions, and need for access. <br /> Government of Indian River County will designate business and technical project <br /> participants who will collaborate with Thomas Penders & Associates in all <br /> aspects of this SOW. These participants attend project meetings as scheduled by <br /> Thomas Penders & Associates. <br /> • Contract Manager — TBD <br /> • Technical Participants — TBD <br /> Thomas Penders & Associates requires that the Government of Indian River <br /> County provide copies of project maps, aerials, Phase I Environmental Site <br /> Assessment, and a letter of permission to conduct an archaeological survey on the <br /> property. <br /> 8.0 Any changes to this SOW will be submitted as a change order to be reviewed and <br /> Changes signed by both Thomas Penders & Associates' Engagement Manager and the <br /> Government of Indian River County's contact person. The change order will detail <br /> any changes to the project scope, price, schedule, and other terms and conditions of <br /> the Professional Services Agreement and this SOW. All change orders will be <br /> submitted on the Thomas Penders & Associates Change Order Document. No <br /> work will be performed as detailed on the change order until both, Thomas Penders <br /> & Associates and Government of Indian River County have signed this document, <br /> unless otherwise approved by both parties. <br /> 9.0 Thomas Penders & Associates acknowledges and accepts that there <br /> Liability are inherent risks in performing archaeological investigations <br /> ("fieldwork"). Thomas Penders & Associates hereby acknowledge, <br /> do now release, acquit and forever discharge Government of Indian <br /> River County the property owner, and all parties holding an interest <br /> in this property or proposed development, from all actions, claims, <br /> demands or damages accruing to me resulting from any known or <br /> unknown injury, loss or damage, sustained on the premises or during <br /> travel to and from the premises. This includes personal injury, <br /> sickness, or damage/loss to personal property. <br /> It is the responsibility of Government of Indian River County to notify any <br /> landowner, occupants, and/or tenants of the property that Thomas Penders & <br /> Associates will be conduct an archaeological, historical, and/or paleontological <br /> survey of the property. Thomas Penders & Associates has a zero tolerance for <br /> violence in the workplace. In the event that an associate of Thomas Penders & <br /> Associates is verbally or physically threatened by a landowner, occupants, and/or <br /> Page 4 of 5 tenants of the property Government of Indian River County will be notified that <br /> this contract will be immediately terminated and the retainer will not be returned. <br />
