The County Engineer reported that the Petitioner has changed the
<br />location of the ditch running along 24th Street from 54th Avenue west
<br />as was requested at the meeting of May 25, 1966 (County Commission -Minute
<br />Book 9, page 626), and thereupon, on Motion by Commissioner Waddell,
<br />seconded by Commissioner Macdonald, the following Resolution was adopted:
<br />RESOLUTION
<br />66-30
<br />BE IT RESOLVED by the Board of County Commissioners of Indian
<br />River County, Florida, that this Board does herewith find and determine as
<br />follows
<br />1, That S. R. SMITH & SONS, INC. , a Florida corporation, by an
<br />through its attorney, Chas. E. Smith, of Heath & Smith, has filed a Petition
<br />before this Board on the 23rd day of March , 1966, at a meeting
<br />of said Board, requesting this Board to adopt a resolution closing, vacating and
<br />abolishing the public roads, streets and rights of way located on the plat of
<br />Eucalyptus Place Subdivision, Unit No. 2, as recorded in Plat Book 5, page 73,
<br />Indian River County public records, as it pertains to the following described
<br />land situated in Indian River County, Florida:
<br />The North 25 feet and the South 25 feet of the right of way of
<br />24th Street lying West of the Western boundary line of 54th
<br />Avenue as shown on the plat of Eucalyptus Place Subdivision,
<br />Unit No. 2, as recorded in Plat Book 5, page 73, public records
<br />of Indian River County, Florida.
<br />2. That this Board has published two weeks' notice thereof one
<br />1-F'NUF "'
<br />time in the Vero Beach Press Journal, a newspaper of general circulation
<br />published in Indian River County, Florida, said notice being published at least
<br />two weeks prior to the date stated therein for such public hearing.
<br />3. That said public roads, streets and rights of way above des-
<br />cribed are not a State or Federal road and are not maintained by the State of
<br />Florida and are not located within the corporate limits of any municipality and°
<br />are located in Indian River County, Florida.
<br />4. That a public hearing thereon has been held by the Board of
<br />County Commissioners of Indian River County, Florida, in the offices of said
<br />Board in the Indian River County Courthouse, Vero Beach, Florida, on the
<br />20th day of April, 1966, at 9:00 o'clock A. M.
<br />5. That S. R. Smith & Sons, Inc. , at said public hearing, with-
<br />drew itsrequest for vacating and closing the South 25 feet of the right of way
<br />of 24th Street of said property.
<br />BE IT FURTHER RESOLVED that this Board does herewith close,
<br />vacate and abandon each and all of the North 25 feet of the right of way of 24th
