AFFIDAVIT OF SELLER

<br /> COUNTY OF INDIAN RIVER
<br /> BEFORE ME , the undersigned authority, personally appeared Thelma Spikes ,
<br /> who being first sworn by me , says that :
<br /> 1 . I am the owner of the following described property, located in Indian River
<br /> County, Florida :
<br /> The East 61 . 8 feet of Lot 1 , Block 7 , BOOKER T .
<br /> WASHINGTON ADDITION TO THE TOWN OF
<br /> VERO , according to the Plat thereof, as recorded
<br /> in Plat Book 2 , at Page 34 , of the Public Records
<br /> of St. Lucie County, Florida , said lands now lying
<br /> and being in Indian River County, Florida .
<br /> 2 . There are no mortgages , liens , tax liens , taxes , interests arising under the
<br /> Uniform Commercial Code , encumbrances , or claims of any kind , nature , and
<br /> description whatsoever against the property except : None
<br /> 3 . There have been no improvements , alterations , or repairs to the property
<br /> made within the past 90 days for which the cost of any part of it remains unpaid .
<br /> 4 . All work , labor, material , and supplies that have been furnished , used , or
<br /> applied on the property within the past 90 days have been fully paid for and
<br /> discharged . There are no construction , materialman ' s , or laborer' s liens against
<br /> the property or any part of it , and no contractor, subcontractor, laborer,
<br /> materialman , engineer, architect , landscape architect , or surveyor has any lien or
<br /> right to lien against the property, or any part of it.
<br /> 5 . There are no parties in possession of the property , and there are no
<br /> parties who have any right of or status in possession , use , or otherwise arising
<br /> from unrecorded leases , land contracts , sales contracts , options , or other
<br /> documents , except me .
<br /> 6 . This affidavit is made for the purpose of inducing Indian River County to
<br /> purchase the property from me .
<br /> 7 . There are no matters pending against me that could give rise to a lien that
<br /> would attach to the property between disbursing of the purchase price and
<br /> recording of the warranty deed from me to the proposed grantees , and I have not
<br /> and will not execute any instrument that would adversely affect the title .
