CONTRACTOR 's failure to make payment to Subcontractors or Suppliers for materials or labor in accordance with the respective agreements between the CONTRACTOR and the Subcontractors or Suppliers . ' SC- 15 . 02 . 6 Delete the third sentence in paragraph GC- 15. 02. 8 and insert the following in its place: ' If the unpaid balance of the Contract Price exceeds all claims , costs , losses , and damages ( including but not limited to all fees and charges of engineers , architects , attorneys , and other professionals and dispute resolution or litigation costs ) sustained by OWNER arising out of or relating to completing the Work , CONTRACTOR will be paid for acceptable earned Work that is fully completed or partially completed , and executed in accordance with the Contract Documents , prior to the effective date of termination .
