V <br /> ORIGINAL <br /> CONTRACT MODIFICATION AGREEMENT 4 F G�3 <br /> This Contract Modification, bearing an effective date of September 23, 2002, is by and <br /> between Indian River County Solid Waste Disposal District, a dependent special district of <br /> Indian River County, Florida, whose address is c/o Indian River County Utilities Department, <br /> 1840 25th Street, Vero Beach, Florida 32960, hereinafter called DISTRICT, and Treasure Coast <br /> Refuse Corporation with its office located at 3905 Oslo Road, Vero Beach, Florida 32968, <br /> hereinafter called the HAULER. <br /> Background Recitals <br /> I. On September 22, 1998 DISTRICT and HAULER entered into the "Schools/County <br /> Buildings Recycling Program Contract". <br /> 2. The initial term of the Contract was two (2) years, commencing September 22, 1998 <br /> with an optional renewal period of three (3) one (1) year periods. The DISTRICT <br /> and the HAULER have exercised two (2) of the option year extensions. <br /> 3. The original awarded price to be paid to the HAULER was $15,240.00 per year. The <br /> price was adjusted to $17,465.64 per year due to increased facilities to be serviced <br /> during the contract. <br /> 4. Paragraphs 9 and 11 of the subject contract allows for mutually agreed changes and <br /> modifications. <br /> 5. The parties desire to modify the Contract to do the following: increase the annual <br /> charge to $17,989.56 per year, a 3% increase to cover the increased cost of <br /> operations. <br /> NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which <br /> is hereby acknowledged, and intending to be legally bound, the parties agree as follows: <br /> 1. The background recitals are true and correct and form a material part of this Contract <br /> Modification Agreement. <br />
