9. Seller has received no notices of any claims of non-payment or claims of liens by any <br />contractors, subcontractors, suppliers, mechanics, materialmen or artisans with respect to any work <br />performed on, or materials furnished to, the Property. <br />10. This Affidavit is made for the purpose of inducing Indian River County, a political <br />subdivision of the state of Florida ("Buyer'), to purchase the Property from Seller, and for the purpose of <br />inducing FATIC and Vista Title Insurance Agency, Inc., as its issuing agent, to issue an owner's policy of <br />title insurance pursuant to its commitment for title insurance issued or to be issued in favor of Buyer. <br />11. There are no matters pending against the Affiant that could give rise to a lien that would <br />attach to the Property between 2008 (the effective date of the commitment) and the <br />recording of the deed conveying the Property to Buyer, and Seller has not and will not execute any instrument <br />or do anything that would adversely affect the interest to be insured pursuant to such commitment. <br />12. Affiant further states that he is familiar with the nature of an oath, and with the penalties as <br />provided by the laws of the State aforesaid for falsely swearing to statements made in an instrument of this <br />nature.
