Roll -Off Charges Per Pull - Enclosed Compactor Type <br />a) 20 cubic yards or less $182.98 per pull <br />b) 21-40 cubic yards $243.90 per pull <br />19. From and after the effective date of this Third Amendment, the existing Article <br />12 of the Agreement is amended by deleting all sections in their entireties and replacing <br />with the following: <br />12.0. Fixed Collection Rates Through September 30, 2009. The District and the <br />Franchisee acknowledge and agree that: (A) the rate for each Residential Unit for <br />Residential Solid Waste Collection Service set forth in section 9.0 of this Agreement, (B) <br />the rates for Residential Recyclables Collection Service per Residential Unit set forth in <br />section 9.2 of this Agreement, (C) the rates for Commercial Collection Service are fixed <br />from October 1, 2007 through and including September 30, 2009, and (D) the Construction <br />and Demolition Debris Service rates are maximum rates as set forth in this Agreement <br />that will not increase from October 1, 2008 through and including September 30, 2009 (all <br />of the foregoing collectively referenced herein as the "FY 2008-2009 Rates'), <br />12.1. Adjustments to Collection Rates, The District and the Franchisee acknowledge and <br />agree that, effective October 1, 2009 (Fiscal Year 2009-2010), and on each October 1 <br />thereafter during the term of this Agreement, any and all of the FY 2008-2009 Rates may <br />be adjusted as calculated herein, subject, however, to an aggregate maximum of seven <br />percent (7%) per annum. Each such adjustment shall consist of the aggregate of the two <br />(2) Collection Rate components [CPI and Fuel and Oil] as set forth herein, and, for the <br />purposes of this Agreement are collectively referenced as "Collection Rate Adjustment'). <br />The Collection Rate Adjustment shall be determined by the weight factors allocated to the <br />two (2) Collection Rate comrponents (CPI and Fuel and Oil] as follows: <br />(A) CPI Collection Rate Component. 90% (Ninety percent) of the change (herein "CPI <br />Collection Rate Component') in the consumer price index for all urban consumers for the <br />South, all items, 1982-84 equals 100, as published by the U.S. Department of Labor, <br />Bureau of Labor Statistics ("CPI'). Should the CPI be discontinued or substantially <br />modified, then an alternate index shall be chosen by mutual agreement of the District and <br />the Franchisee. Effective October 1, 2009, and on each October 1 thereafter during the <br />term of this Agreement, the change in the CPI shall be calculated as the percentage <br />change from July of the immediately preceding year to July of the current year; and <br />(B) _Fuel and Oil Collection Rate Component. 10% (ten percent) of the percentage change <br />in the average price of diesel fuel for the Lower Atlantic No 2 Ultra Low Sulfur Diesel Retail <br />7 <br />
