Heiser , Senior Attorney <br /> Department of Environmental Protection <br /> 3900 Commonwealth Blvd MS35 <br /> Tallahassee , FL 32399- 3000 <br /> RELEASE OF SITE DEDICATION <br /> THIS RELEASE OF SITE DEDICATION is made this day of <br /> 2009 by and between the STATE OF FLORIDA DEPARTMENT OF <br /> ENVIRONMENTAL PROTECTION (successor in interest to State of Florida Department <br /> of Natural Resources ) , DIVISION OF RECREATION AND PARKS , whose mailing <br /> address is 3900 Commonwealth Boulevard , Mail Station 500, Tallahassee , Florida <br /> 32399 -3000 (" DRP") and INDIAN RIVER COUNTY , a political subdivision of the State of <br /> Florida , whose mailing address is 1801 27th Street , Vero Beach ; Florida 32960 -3388 <br /> (the "'County " ) . <br /> WITNESSETH : <br /> '..WHEREAS , the County owns the following described lands located in Indian <br /> River County , Florida ( " Property <br /> All of Government Lot in Section 14 , Township 31 , South Range 39 East <br /> Indian River County , Florida , lying east of the east right- of�way line of <br /> State 'Road A- 1 -A , EXCEPT the North 400 feet of same ; and <br /> .WHEREAS , the County acquired the Property with financial assistance provided <br /> by DRP in accordance with Chapter 161D- 5 , Florida Administrative Codes and <br /> WHEREAS , pursuant to the requirements of said rule the County was required to <br /> dedicate the Property to the public in perpetuity as an outdoor recreation area for the <br /> use and benefit of thre general public; and <br /> WHEREAS -.on February 8 , 1989 ,. the County executed the Notice of Limitation of <br /> Use/Site Ded catmn `that is recorded in Offcial Records, Book 082"2 ; Page '1755, , Public <br /> U <br /> Records of Indian River County (' Site Dedication- ) , and <br /> WHEREAS ; the .County h .as requested that DRP release the Property from the <br /> Site Dedication so that the County may dispose of the Prop.efty ; and <br /> WHEREAS , in consideration of D.RP ' s release of the Property from the Site <br /> Dedication , the County is willing to place a similar notice of limitation of use /site <br /> dedication on other lands owned by the County . <br />
