RESOLUTION NO. 67-42 <br />BE IT RESOLVED by the Board of County Commissioners of <br />Indian River County, Florida, that pursuant to the powers vested in this <br />Board by the beverage laws of the State of Florida, the location of places of <br />business of vendors of alcoholic beverages licensed under the beverage laws <br />of the State of Florida in the territory of this county lying without the limits <br />of incorporated cities or towns is hereby fixed and determined as follows: <br />1. The place of business of any vendor of alcoholic beverages <br />must be located in a district or zone where the general type of retail business <br />in which the vendor is principally engaged is specifically permitted by the <br />general zoning resolution of the county. <br />2. This Board does hereby establish the following zones or areas <br />wherein vendors of alcoholic beverages other than vendors licensed under <br />paragraph (c) of subsection (1) of Section 561.34, Florida Statutes ,(vendors <br />of alcoholic malt beverages commonly known as beer for consumption off the <br />premises only) are prohibited from locating their places of business: <br />(a) All of the area lying within 2,340 feet North and lying <br />within 2,340 feet South of the centerline described as follows: Begin at the <br />intersection of State. Road No. 5, also known as U. S. Highway No. 1, and <br />the North Gifford Road and thence West along the centerline of the North <br />Gifford Road a distance of :three:"fourths of. one mile. <br />(b) All that area known as Graves Addition to Wabasso <br />according to Plat thereof recorded in Plat Book 2, page 41, in the office of the <br />Clerk of the Circuit Court of Indian River County, Florida. <br />3. This Board does hereby prohibit vendors of alcoholic beverages <br />other than vendors licensed under paragraph (c) of subsection (1) of <br />Section 561.34, Florida Statutes (vendors of alcoholic malt beverages common <br />ly known as beer for consumption off the premises only) from locating their <br />places of business within 2,500 feet of an established church or school <br />measured by following the shortest route of ordinary pedestrian travel along <br />the public thoroughfare from the main entrance of such place of business to th <br />main entrance of the church and, in the case of a school, to the nearest point o <br />Smith, Heath, Smith & O'Haire, Attorneys At Law, Vero Beach, Florida.*.
