BARTON , CLERK <br /> RELEASE OF LANDSCAPE EASEMENT <br /> WHEREAS , 'on November 10 , 2009 , Century Town Center granted <br /> an easement for landscape purposes to Indian River County , Florida ; said <br /> easement being recorded in the Century Town Center Plat at Plat Book 24 , Page <br /> 64 of the Public Records of Indian River County , Florida ; and <br /> WHEREAS , the plat of Century Town Center dedicated the <br /> landscape easement to Indian River County as a buffer in the easement ; and <br /> WHEREAS , plans submitted to the County to construct the ABC <br /> Liquor Store show an encroachment upon the County ' s landscape easement ; <br /> and <br /> WHEREAS , the Board of County Commissioners wishes to partially <br /> release this easement as the easement serves only the proposed ABC Liquor , <br /> Inc . site and no other properties , <br /> NOW, THEREFORE , THIS PARTIAL RELEASE OF EASEMENT <br /> is executed on behalf of the Board of County Commissioners of Indian River <br /> County , a political subdivision of the State of Florida , whose mailing address is <br /> 1801 27th Street , Vero Beach , Florida 32960 , Grantor , to <br /> ABC Properties , Ltd . <br /> c/o Ross Galbraith , Esq . <br /> Dyer, Riddle , Mills & Precourt, Inc . <br /> 941 Lake Baldwin Lane <br /> Orlando , FL 32814 <br /> their successors in interest , heirs and assigns , Grantee , as follows : <br /> Indian River County does hereby release and abandon all right , <br /> title , and interest that it may have in the following described easement : <br /> See Exhibit "A " attached hereto . <br /> 1 <br />
