A Motion was made by Commissioner Dritenbas, seconded by <br />Commissioner Macdonald and the following Resolution was unanimously <br />adopted: <br />RESOLUTION NO. 68-. 39 <br />The Board of County Commissioners of Indian River County, <br />Florida, resolves: <br />1. That the property located in Indian River County, Florida, <br />described as: <br />The West 20.79 acres of Tract 5, Section 15, Town- <br />ship 33 South, Range 39 East, according to the last <br />general plat of lands of the Indian River Farms Company <br />filed in the office of the Clerk of the Circuit Court of <br />St. Lucie County, Florida, in Plat Book 2, page 25; <br />became the property of Indian River County, Florida, because of the non- <br />payment of taxes as determined by decree of the Circuit Court of Indian River <br />County, Florida, in that certain cause styled "Indian River County vs. Certain <br />Lands in Chancery No. 2398," which said decree was recorded in Chancery <br />Order Book 11, page 155, on the 14th day of August, 1944, all in accordance <br />with the provisions of Chapter 20722, Laws of Florida; Acts of 1941, and sub- <br />sequent amendments thereto now appearing as a' part of Chapter 194, Florida <br />Statutes; and <br />2, This Board did, in accordance with the provisions of that law, <br />fix the value of said lands and the price of sale by Resolutionrecorded by the <br />Clerk of the Circuit Court in the book designated "County Lands Acquired For <br />Delinquent Taxes," and this Board did thereafter sell said lands at public sale <br />to the highest bidder for cash, free and clear of liens held by the County and <br />the Indian River Farms Drainage District, wherein said lands lie. The lands <br />are not situated within a municipality. At said sale, said lands were sold to <br />the former owner, the Indian River Farms Drainage District, a drainage dis- <br />trict organized and existing under the general drainage laws of the State of <br />Florida„ andthereafter a deed of conveyance to the purchaser was executed an <br />recorded in Deed Book 44, page 214, in the office of the Clerk of the Circuit <br />Court of Indian River County, Florida, but said deed of .conveyance, through <br />scrivener's error, omitted from the description of said lands that part thereof <br />described as "the East , 79 acres" of the above described property. <br />BOOk pw.266 <br />Smith, Heath, Smith & O'Haire, Attorneys At Law, P.
