Indian River County Sector 3 Phase 2b — During Construction Phase Services <br /> Scope of Work <br /> Part 3 — Monitoring - During Construction <br /> In general, work described in Part 3 constitutes during construction monitoring required by FDEP or <br /> the USACE permits consistent with the USF&WS Biological Opinion dated December 2, 2009 . It is <br /> expected that the monitoring under this Scope of Work will be accepted by FDEP as <br /> during <br /> construction monitoring . Subsequent permit-required Biological or Physical Monitoring is not <br /> addressed in this Scope of Work. <br /> Task 3a — Permit Administration : COASTAL TECH will confer with the COUNTY , the <br /> Contractor, USACE and FDEP staff to check and document that the Contractor and COUNTY have <br /> fulfilled monitoring and reporting requirements as cited in the permits for all phases of construciton . <br /> COASTAL TECH will: <br /> ( a) Prepare a tabular summary of permit requirements , the responsible entity for each applicable <br /> permit condition , and the required date for compliance . <br /> (b) Assist the COUNTY with documentation of permit compliance . <br /> (c) Maintain a written schedule and summary of permit compliance including dates that <br /> requirements are met and/or submitted to the agencies . <br /> Task 3b — During Construction Sea Turtle, Lighting, & Shorebird Monitoring : On a daily basis <br /> during Phase 2b construction (herein assumed to potentially extend into the period from March 1 <br /> through April 30), to fulfill requirements of FDEP Specific Conditions 19 and item 3 (including 3a <br /> through 3c ) of the "Terms and Conditions" for the "Protection of sea turtles" in the <br />USF& WS <br /> Biological Opinion dated December 2, 2009 — in accordance with Florida Fish & Wildlife <br /> Conservation Commission (FFWCC) guidelines , EAI shall : <br /> • monitor the beach for nests throughout the entire Project area (R20 to R55) , <br /> • monitor, relocate, and/or mark sea turtle nests along the entire Phase 2b construction area — <br /> from R -20 to R-33 including Construction Access Areas at Golden Sands Park and Treasure <br /> Shores Park. <br /> Nighttime monitoring will not be required due to use of upland sand sources . EAI will directly confer <br /> with existing Marine Turtle Permit Holders in collaboration with the COUNTY to appropriately <br /> coordinate the Project monitoring by EAI with the existing yearly monitoring efforts . <br /> EAI will also conduct a pre-construction beachfront lighting surveys as required by item 11 (pre- <br /> construction survey ) of the "Terms and Conditions" for the "Protection of sea turtles" by <br /> the <br /> USF&WS Biological Opinion dated December 2, 2009. <br /> In conjunction with sea turtle Monitoring, EAI shall also conduct early nesting season shorebird <br /> surveys along the entire Phase 2b construction area (R20 to R33 ) including Construction Access <br /> Areas - as required by FDEP Specific Condition 35 (commencing April 1 through August) . <br /> On a daily basis during Phase 2b construction, EAI will notify the COUNTY , COASTAL TECH and <br /> the CONTRACTOR by email or phone within 1 hour of the completion of surveys as to the location <br /> of any nests , turtles or shorebirds which must he avoided by the CONTRACTOR . <br /> Page 4 of 4 <br /> August 17 , 2011 <br />
