The RECIPIENT shall provide a harassment- free workplace, with any allegation of harassment <br /> given priority attention and action by management. The RECIPIENT shall insert a provision in <br /> accordance with this Section, in all subcontracts for services in relation to this Agreement. <br /> 30 . PUBLIC ENTITY CRIMES , <br /> The RECIPIENT affirms that it is aware of the provisions of Section 287 . 133 (2) (a) , Florida Statutes , <br /> and that at no time has the RECIPIENT been convicted of a Public Entity Crime . The <br /> RECIPIENT agrees that it shall not violate such law and further acknowledges and agrees that any <br /> conviction during the term of this Agreement may result in the termination of this Agreement in <br /> accordance with Section 287 . 133 (4) . The RECIPIENT shall insert a provision in accordance with <br /> this Paragraph in all subcontracts for services in relation to this Agreement. <br /> 31. UNAUTHORIZED ALIENS <br /> The DEPARTMENT will consider the knowing employment of unauthorized aliens, as described in <br /> Section 274A (e) of the Immigration and Nationality Act, . by any RECIPIENT,cause for termination <br /> of this Agreement. Paragraph 23 . b . does not apply regarding the employment of unauthorized <br /> aliens . The RECIPIENT shall insert a provision in accordance with this Section in all subcontracts <br /> for services in relation to this Agreement <br /> 32 . LOBBYING : <br /> a . The RECIPIENT shall not use any funds received pursuant to this Agreement for lobbying the <br /> Florida Legislature, the judicial branch, or any state agency . Pursuant to section 11 . 062 , Florida <br /> Statutes , the RECIPIENT shall insert a provision in accordance with this Section in all subcontracts <br /> for services in relation to this Agreement. <br /> b . The RECIPIENT will keep the DEPARTMENT apprised on a current basis regarding requests <br /> for testimony or its participation in Congressional, Legislative, and / or other state or federal <br /> hearings , agency meetings , committees , task forces , etc. The RECIPIENT will include reports of its <br /> participation in such events in the quarterly reports described in Exhibit A . <br /> 33 . ATTORNEY FEES: <br /> Unless authorized by law and agreed to in writing by the DEPARTMENT, the DEPARTMENT <br /> shall not be liable to pay attorney fees , interest, or costs . <br /> 34. NON-ASSIGNMENT : <br /> a . Except as otherwise provided in this Agreement, the RECIPIENT may not assign, delegate, nor <br /> otherwise transfer its rights , duties, or obligations under this Agreement without the prior written <br /> consent of the DEPARTMENT, which consent will not be unreasonably withheld . Any <br /> assignment, delegation, or transfer in violation of this paragraph is void ab initio . The RECIPIENT <br /> hereby agrees that it shall remain responsible for all work performed and all expenses incurred in <br /> connection with this Agreement, regardless of any and all assignment, delegation, or transfer. <br /> Page 10 of 21 <br />
