24. If the Grantee ' s project involves environmentally-related measurements or data generation, including the <br /> development of models that may be used in regulatory decisions, the Grantee shall develop and implement <br /> quality assurance practices consisting of policies, procedures, specifications, standards, and documentation <br /> sufficient to produce data of quality adequate to meet project objectives and to minimize loss of data due to <br /> out-of-control conditions or malfunctions. All sampling and analyses performed under this Agreement must <br /> conform with the requirements set forth in Chapter 62460, Florida Administrative Code, and the Quality <br /> Assurance Requirements for Department Agreements , attached hereto and ' made part hereof as Attachment <br /> J, Quality Assurance Requirements. <br /> 25 . A. No person, on the grounds of race, creed, color, national origin, age, sex, or disability, shall <br /> be <br /> excluded from participation in; be denied the proceeds or benefits of; or be otherwise subjected to <br /> discrimination in performance of this Agreement. <br /> Be An entity or affiliate who has been placed on the discriminatory vendor list may not submit a bid <br /> on a contract to provide goods or services to a public entity, may not submit a bid on a contract <br /> with a public entity for the construction or repair of a public building or public work, may not <br /> submit bids on leases of real property to a public entity, may not award or perform work as a <br /> contractor, supplier, subcontractor, or consultant under contract with any public entity, and may <br /> not transact business with any public entity. The Florida Department of Management Services is <br /> responsible for maintaining the discriminatory vendor list and intends to post the list on its website. <br /> Questions regarding the discriminatory vendor list may be directed to the Florida Department of <br /> Management Services, Office of Supplier Diversity at (850) 487-0915 . <br /> 26 . In accordance with Executive Order 12549, Debarment and Suspension (2 CFR 180 and 1532), <br /> the <br /> Grantee agrees and certifies that neither it, nor its principals, is presently debarred, suspended, proposed for <br /> debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal <br /> department or agency; and, that the Grantee shall not knowingly enter into any lower tier contract, or other <br /> covered transaction, with a person who is similarly debarred or suspended from participating in this covered <br /> transaction, unless authorized in writing by EPA to the Department. The Grantee shall include the language <br /> of this section in all subcontracts or lower tier agreements executed to support the Grantee ' s work under this <br /> Agreement. <br /> 27. The Environmental Protection Agency and Department reserve a royalty-free, nonexclusive, and irrevocable <br /> license to reproduce, publish or otherwise use, and to authorize others to use, for government purposes. <br /> A. The copyright in any work developed under a grant, subgrant, or contract under a grant <br /> or <br /> subgrant. <br /> B . Any rights of copyright to which a grantee, subgrantee or a contractor purchases ownership with <br /> grant support. <br /> 28 . The Grantee agrees to comply with, and include as appropriate in contracts and subgrants, the provisions <br /> contained in Attachment K, Contract Provisions, attached hereto and made a part hereof. In addition, the <br /> Grantee acknowledges that the applicable regulations listed in Attachment L Regulations, attached hereto <br /> and made a part hereof, shall apply to this Agreement. <br /> 29 . Land acquisition is not authorized under the terms of this Agreement. <br /> 30 . If a court deems any provision of this Agreement void or unenforceable, that provision shall be enforced <br /> only to the extent that it is not in violation of law or is not otherwise unenforceable and all other provisions <br /> shall remain in full force and effect. <br /> DEP Agreement No. G0353 , Page 11 of 13 <br />
