BARTON , CLERK <br /> RECITALS <br /> WHEREAS , the State of Florida, Department of Community Affairs (DCA or <br /> Department) , is the state land planning agency and has the authority to administer and enforce <br /> the Local Government Comprehensive Planning and Land Development Regulation Act, Chapter <br /> 163 , Part II, Florida Statutes ; and <br /> WHEREAS , the City of Fellsmere (City) is a local government with the duty to adopt <br /> comprehensive plan amendments that are "in compliance ; " and <br /> WHEREAS , the City adopted Comprehensive Plan Amendments (Plan Amendments) by <br /> Ordinance Nos . 08 - 14 and 08 - 15 on May 21 , 2009 ; and <br /> WHEREAS , the Plan Amendments propose to amend the City ' s Comprehensive Plan <br /> (Plan) to establish a new land use category called the Villages of Fellsmere (VOF) ; revise the <br /> Future Land Use Map to apply the VOF designation to approximately 18 , 388 acres of land <br /> annexed into the City ; revise the future land use map to apply the Medium Density Residential <br /> designation to approximately 157 acres of land; amend the Plan to include new and revised <br /> objectives and policies in the Future Land Use Element to allow the development of up to 19 , 750 <br /> residential units and up to 8 . 0 million square feet of non-residential development within the area <br /> designated as VOF ; revise the goals , objectives , and policies sections of other Plan elements to <br /> update the long range planning timeframe established in the Plan from 2020 to 2030 ; and revise <br /> the development criteria in Future Land Use Policy FLUE B - 2 . 6 , Low Density Mixed Use <br /> Neighborhood (LDMXN) ; and <br /> WHEREAS , the Department issued its Statement and Notice of Intent regarding the Plan <br /> Amendments on July 17 , 2009 ; and <br /> 2 <br />
