MS 300 f I <br /> Tallahassee , Florida 32399 <br /> AD <br /> SECOND REVISED CONSERVATION EASEMENT <br /> This Second Revised Conservation Easement is made this day of 2011 , by <br /> and between NORTH SHORE CLUB , LLC , 21 Royal Palm Pointe , Suite 100 , Vero Beach , <br /> Florida ( " Grantor" ) , INDIAN RIVER COUNTY (" COUNTY") , a political subdivision of the <br /> State of Florida, and the FLORIDA DEPARTMENT OF ENVIRONMENTAL <br /> PROTECTION (" DEPARTMENT" ) ( " Grantees " ) : <br /> WITNESSETH <br /> WHEREAS , Grantor is the sole fee simple owner of certain real property situated in <br /> Indian River County , Florida, and more specifically described in Exhibit " A " , attached hereto <br /> and incorporated herein (the " Property" ) ; and <br /> WHEREAS , Grantor requested : ( 1 ) Preliminary PD Plan/Plat Approval (PD - 11 - 01 - <br /> 02 /2003010058 - 66029 ) from Indian River County ; and ( 2 ) a permit from the State of Florida <br /> Department of Environmental Protection ( " FDEP " ) , FDEP Permit IR- 842 , to construct certain <br /> improvements on the Property , some of which are seaward of the coastal construction control <br /> line , <br /> WHEREAS , the establishment of a conservation easement is required by Indian River <br /> County Code Section 929 . 05 with respect to native plant communities which occur on the <br /> Property , and <br /> WHEREAS , DEPARTMENT Permit No . IR- 842 (Permit) authorizes certain activities <br /> which alter, excavate, and construct on property seaward of the established coastal construction <br /> control line (CCCL) ; and <br /> WHEREAS , pursuant to section 161 . 053 (4 ) , F . S . , the DEPARTMENT may require <br /> mitigation as a condition of the permit to offset impacts to the beach- dune system ; and <br /> WHEREAS , a conservation easement on the Property was established and recorded at <br /> OR Book 1039 , Page 2590 , Public Records of Indian River County , Florida, on November 17 , <br /> 1994 (the " Original Conservation Easement" ) ; and <br /> WIEREAS , a revised conservation easement on the Property was established and <br /> recorded at OR Book 2075 , Page 1556 , Public Records of Indian River County , Florida , on June <br /> 21 , 2006 (the " Revised Conservation Easement") ; <br /> WHEREAS , the projects associated with the established Original Conservation Easement <br /> and Revised Conservation Easement , as to Parcel B . were not and will not be built ; and <br />
