DUNS No . : ZQ - C15CL 110aj Contract: No . : APG-29 <br /> CSFA No. : N/A FM No : 228613 - 2 - 54 - 01 <br /> Vendor No : VF - 596 - 000 - 674 <br /> STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br /> AND <br /> INDIAN RIVER COUNTY <br /> JOINT PARTICIPATION AGREEMENT <br /> AMENDMENT NUMBER ONE <br /> THIS AMENDMENT, made and entered into this 111" day of Njej 20 1 l , by <br /> and between the State of Florida Department of Transportation , hereinafter called the DEPARTMENT , and <br /> Indian River County, located at 1801 27°i Street, Vero Beach , Florida 32960 , hereinafter called the COUNTY . <br /> WITNESSETH <br /> WHEREAS , on March 19 , 2009 the parties entered into a Joint Participation Agreement, hereinafter <br /> referred to as the AGREEMENT, wherein the PARTICIPANT agreed to provide certain improvements in <br /> connection with Financial Management (FM) No . 228613 - 2 - 54 - 01 for the Enhancement and Operations of the <br /> Computerized Traffic Control Signal System that monitors and controls the traffic signals at intersection on <br /> the State Highway Roadway System within the limits of Indian River County, Florida hereinafter referred to <br /> as the Project; and, <br /> WHEREAS , the parties desire to amend the AGREEMENT ; and <br /> WHEREAS , the parties hereto mutually agree that this Amendment is in their best interest; <br /> NOW , THEREFORE , in consideration of the mutual covenants , promises, and representations herein, <br /> the parties agree to amend the Agreement dated March 19 , 2009 , as follows : <br /> I The recitals set forth above are true and correct and are deemed incorporated herein . <br /> 2 . Paragraph Twenty Four, page 5 , is amended to read as follows : <br /> Except as otherwise set forth herein , this AGREEMENT shall continue in effect and be binding to <br /> both the COUNTY and the DEPARTMENT until the Project is completed as evidenced by the <br /> written acceptance of the DEPARTMENT or June 30, 2011 , whichever occurs first. <br /> 3 . The Agreement is amended to add the following provision : <br /> The Vendor/Contractor shall utilize the United States (U. S .) Department of Homeland Security ' s E -Verify <br /> system , in accordance with terms governing use of the system , to confirm theemployment eligibility of: <br /> 1 ) At] persons employed by the Vendor/Contractor during the term of the contract to perform <br /> employment duties within the Florida; and <br /> 2) All persons, including subcontractors , assigned by the Vendor/Contractor to perform work pursuant to <br /> the contract with the DEPARTMENT . <br /> Page 1 of 2 <br />
