<br />B. . Compliance with Federal Laws, Rules and Regulations. As applicable, the Grantee shall
<br />comply with all federal laws, rules, and regulations, including but not limited to:
<br />• Executive Order 11246 of September 24, 1965, entitled "Equal Employment
<br />Opportunity,' as amended by Executive Order 11375 of October 13, 1967, and as
<br />supplemented in Department of Labor regulations (41 CFR Chapter 60).
<br />• The Copeland "Anti -Kickback" Act (18 U.S.C. 874) as supplemented in Department of
<br />Labor regulations (29 CFR part 3).
<br />• Sections 103 and 107 of the Agreement Work Hours and Safety Standards Act (40 U.S.C.
<br />327-330) as supplemented by Department of Labor regulations (29 CFR part 5).
<br />(Construction agreements awarded by grantees and subgrantees in excess of $2,000, and
<br />in excess of $2,500 for other agreements which involve the employment of mechanics or
<br />laborers)
<br />• All applicable standards, orders, or requirements issued under section 306 of the Clean Air
<br />Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U S.C. 1368), Executive
<br />Order 11738 and Environmental Protection Agency regulations (40 CFR part 15).
<br />• Mandatory standards and policies relating to energy efficiency which are contained in the
<br />State energy conservation plan issued in compliance with the Energy Policy and
<br />Conservation Act (Pub. L. 94-163, 89 Stat. 871).
<br />C. Compliance with Office of Management and Budget Circulars. As applicable, Grantee shall
<br />comply with the following Office of Management and Budget Circulars*
<br />• A-21 (2 CFR 220), Cost principles for Educational Institutions
<br />• A-87 (2 CFR 225), Cost Principles for State, Local, and Indian Tribal Governments
<br />• A-122 (2 CFR 230) Cost Principles for Non -Profit Organizations
<br />• A-133, Audit of States, Local Governments, and Non -Profit Organizations
<br />• A-102, Grants and Cooperative Agreements with State and Local Governments
<br />• A-110, Uniform Administrative Requirements for Grants and Other Agreements with
<br />Institutions of Higher Learning, Hospitals, and Other Non -Profit Organizations
<br />Certifications and Assurances — Drug -Free Workplace. Pursuant to the Drug -Free Workplace
<br />Act of 1988, and its implementing regulations codified at 29 CFR Part 94, the Grantee will
<br />provide a drug-free workplace Upon execution of this Agreement by the Grantee, the Grantee
<br />shall complete, sign and return to the Commission a completed copy of Attachment B,
<br />"Certifications and Assurances. ' This includes the Drug -Free Workplace Requirement
<br />Certification.
<br />E. Trafficking Victims Protection Act of 2000. This federal award is subject to the Trafficking
<br />Victims Protection Act of 2000, as amended (22 U.S.0 7104(g), 2 CFR 175 15). As such, the
<br />awarding federal agency may unilaterally terminate this award without penalty for violations of
<br />this Act. If the Grantee is a private entity, the following provision applies to the federal award*
<br />You as the recipient, your employees, subrecipients under this award, and subrecipients'
<br />employees may not-
<br />a. Engage in severe forms of trafficking in persons during the period of time that the
<br />award is in effect;
<br />b. Procure a commercial sex act during the period of time that the award is in effect; or
<br />c. Use forced labor in the performance of the award or subawards under the award
<br />27. DEBARMENT AND SUSPENSION.
<br />A. Grantee Federal Certification. In accordance with Executive Order 12549, Debarment and
<br />Suspension, the Grantee shall agree and certify that neither it, nor its principals, is presently
