Attachment A — SCOPE OF WORK <br />Project Name. <br />Indian River County Artificial Reef <br />Construction 2013-2014 <br />FWC Agreement No. <br />13127 <br />accompanying tug or at the shore -side loading area results in an unexpected short <br />term delay. In both situations a) and b), the reef material must either be at the staging <br />area ready for immediate loading on the transport vessel or already loaded and ready <br />for transport and deployment as of August 21, 2014. Advance planning that avoids <br />dependence on a favorable weather window during the final days of the project is <br />strongly encouraged. All request for bid packages from the GRANTEE to <br />subcontractors must include language that specifies a completion date that ensures all <br />materials will be in the water by August 21, 2014. Subcontracts with completion <br />dates even earlier than August 21, 2014 to provide an additional buffer are strongly <br />encouraged. <br />3. FINANCIAL CONSEQUENCES <br />A. If the GRANTEE fails to complete construction within the time frame specified by the Scope <br />of Work, the budget amount allocated for that deliverable will be deducted from the <br />Grantee s payment. <br />B. The GRANTEE will not be eligible for reimbursement until all reports have been provided <br />to the satisfaction of the COMMISSION documenting that all work has been completed in <br />accordance with the Scope of Work, and in compliance with all permit conditions. <br />4. PERFORMANCE <br />A. Written or electronically transmitted progress reports must be sent to the COMMISSION's <br />Contract Manager at no less than 60 day intervals beginning from the date of execution of <br />this agreement. <br />B . The GRANTEE agrees to provide the COMMISSION with a minimum of five (5) days. <br />notice for any artificial reef construction that occurs as a result of this Agreement. <br />C. The GRANTEE agrees to follow all provisions of Section 379.249, Florida Statutes and <br />Chapter 68E-9, Florida Administrative Code during the term of this Agreement. <br />D . The GRANTEE agrees to comply with all applicable federal, state, and local statutes, rules <br />and regulations in providing goods or services to the COMMISSION under the terms of this <br />Agreement; including the general and special conditions specified in any permits issued by <br />the Department of the Army, Corps of Engineers and/or the Florida Department of <br />Environmental Protection. The GRANTEE further agrees to include this as a separate <br />provision in all subcontracts issued as a result of this Agreement. <br />E . This Agreement is funded in whole or in part by a grant from the U.S. Fish and Wildlife <br />Service, Federal Aid in Sport Fish Restoration Program, CFDA No. 15.605. Therefore, the <br />GRANTEE shall be responsible for complying with all federal grant requirements as <br />provided in the grant, a copy of which is attached hereto and made a part hereof as <br />Attachment D It is understood and agreed that the GRANTEE is not authorized to expend <br />Version 1.0 — June 2013 Attachment A, Page 7 of 12 <br />
