Florida Municipal Pension Trust Fund <br /> 457(b) Deferred Compensation Plan <br /> 17. 29 Unclaimed property <br /> For the purposes of any unclaimed property statute, if a Distribution has not commenced , <br /> any Deferred Compensation does not become distributable until such time as a <br /> Distribution is mandatory under the terms of the Plan . <br /> 17 .30 Unemployment compensation <br /> For the purposes of any unemployment compensation law, a Distribution in one sum or <br /> as installments for a period of not more than one year, to the extent attributable to <br /> Employer Contributions , is deemed a severance payment and shall be so allocated (for <br /> the purposes of the applicable unemployment compensation law ) over a period of weeks <br /> equal to the amount of the Distribution divided by the Participant ' s regular weekly pay <br /> before the Severance with this period beginning on the first week that begins after the <br /> date of the Severance . <br /> 17 .31 Venue <br /> If any person , including , without limitation , any Participant or Beneficiary or Alternate <br /> Payee or Distributee ( or any person claiming through a Participant or Beneficiary or <br /> Alternate Payee or Distributee) brings or maintains any suit or action (other than as <br /> described by the other sentence of this paragraph) against the Plan Administrator or the <br /> Master Trustee or to which the Plan Administrator or the Master Trustee is or becomes a <br /> party , each such person hereby submits to exclusive jurisdiction and exclusive venue in <br /> the courts sitting in Leon County , Florida or in which the Plan Administrator has its <br /> principal place of business . However, any suit or action upon an arbitration award or <br /> relating to an arbitration shall be governed by the internal laws (without regard to the law <br /> of conflicts) of the State in which the arbitration was conducted, and each such person <br /> who is or was a party to an arbitration hereby submits to exclusive jurisdiction and <br /> exclusive venue in the courts sitting in and for the district in which the city or place of <br /> the arbitration is located. <br /> 18 . Amendment <br /> 18 . 1 Master Trustee ' s right to amend the Plan <br /> The Master Trustee has the right to amend the Plan at any time . The Participating Employer <br /> has the right to discontinue the Plan at any time , subject to the limitations set forth in the <br /> Trust Joinder Agreement and Master Trust Agreement . Any amendment of the Plan has no <br /> effect on the Master Trust Agreement . The Plan Sponsor may not amend the Plan in any <br /> way. <br /> 18 .2 Amendment can ' t change exclusive benefit <br /> To the extent required by Provision 1 . 7 ["Exclusive benefit"] , any amendment of the Plan <br /> shall not be effective to the extent that the amendment has the effect of causing any Plan <br /> assets to be diverted to or inure to the benefit of the Participating Employer, or to be used for <br /> any purpose other than providing Deferred Compensations to Participants and Beneficiaries <br /> and defraying reasonable expenses of administering the Plan . <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities, Inc . <br /> Page 58 <br /> 02,'01 /2009 <br />
