Florida Municipal Pension Trust Fund <br /> 457(b) Deferred Compensation Plan <br /> If the Participant designates more than one Beneficiary, upon the written request of any <br /> Beneficiary or upon an approved claim payable to any Beneficiary and not all Beneficiaries , <br /> the Plan shall maintain a separate account with respect to the interest of each Beneficiary, <br /> beginning as of the next Valuation Date that occurs after the Beneficiary ' s request or claim is <br /> received by the Plan Sponsor . <br /> If a Plan- approved Domestic Relations Order applies with respect to a Participant , the <br /> Plan shall maintain a separate account for the interest of the Alternate Payee, beginning <br /> as of the next Valuation Date available after the court order is determined by the Plan <br /> Sponsor to be a Plan- approved Domestic Relations Order. <br /> A Participant ' s Plan Account shall be reduced to the extent that any portion of the <br /> Participant ' s Plan Account has been paid or set aside for payment to an Alternate Payee <br /> or to the extent that the Participating Employer or the Master Trustee or the Plan <br /> Administrator or the Agent otherwise is subject to a binding judgment, decree , or order <br /> for the attachment, garnishment, or execution of any portion of the Participant ' s Account <br /> or of any distribution therefrom . The Participant shall be deemed to have released the <br /> Participating Employer and the Master Trustee and the Plan Administrator and the Agent <br /> from any claim with respect to such amounts in any case in which any of them was <br /> served with legal process or otherwise joined in a proceeding relating to such amounts , <br /> and the Participant was notified of the pendency of such proceeding , and the Participant <br /> fails to obtain an order of the court that relieves the Participating Employer and the <br /> Master Trustee and the Plan Administrator and the Agent from any obligation to comply <br /> with the judgment, decree , or order . <br /> Each Account statement or Confirmation furnished by (or on behalf of) the Plan <br /> Administrator or the Master Trustee is intended as a legally significant statement of the <br /> Participant ' s Deferred Compensation. As to each Account statement or Confirmation , if, by <br /> the date that is 180 days after the date that the statement or Confirmation was mailed or <br /> otherwise sent or delivered, the Participant ( or Beneficiary or Alternate Payee) has not <br /> delivered a written objection as to the accuracy of the statement, the accounting reported is <br /> then settled and conclusive and all account stated. If an objection to any Account statement <br /> or Confirmation is withdrawn or is adjusted to the objector ' s satisfaction, the accounting is <br /> then settled and conclusive and an account stated . To the extent that an Account statement <br /> or Confinnation is an account stated , the Plan Administrator and every party acting under the <br /> instruction of the Plan Administrator is discharged from any liability that might otherwise <br /> arise out of the Account statement as fully as if the Account had been settled by an <br /> appropriate court proceeding . Without limiting the comprehensive effect of the above , if an <br /> Account statement or Confirmation furnished to the Alternate Payee shows the amount <br /> segregated to his or her separate sub-Account under a Plan- approved Domestic Relations <br /> Order or other court order if, by the date that is 180 days after the date that the statement or <br /> Confirmation was mailed or otherwise sent or delivered, the Alternate Payee has not <br /> delivered a written objection as to the accuracy of the statement or the objection is <br /> withdrawn or is adjusted to the Alternate Payee ' s satisfaction, the accounting reported is then <br /> settled and conclusive and an account stated , and shall constitute a release of any obligation <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities, Inc . <br /> Page 7 <br /> 02,'01 /2009 <br />
