Florida Municipal Pension Trust Fund <br /> 457(b) Deferred Compensation Plan <br /> 7 . Allocation methods <br /> 7. 1 Employee Contributions <br /> Each Employee may elect to defer a portion of his or her Compensation as Employee <br /> Contributions, subject to all limitations of the Plan. <br /> 7. 2 Employer Contributions are discretionary <br /> This Provision applies only if Employer Contributions are permitted by the Enabling Statute. <br /> All Employer Contributions under this Plan are discretionary and the Employer <br /> Contributions made ( if any) for any Year shall be as declared by each Participating <br /> Employer. All Employer Contributions shall be allocated as specified by the Participating <br /> Employer. <br /> 7.3 Plan Accounts <br /> The Plan Administrator shall keep (or cause to be kept) the Account for each Participant (or <br /> Beneficiary) . <br /> 7.4 Allocation of investment return <br /> To the extent that an Account is held under an Allocated Investment (as defined below) , all <br /> income, gains, losses , other elements of investment return or contract value, and expenses <br /> shall be allocated as provided by the Investment . <br /> To the extent that an Account is held under an Unallocated Investment, all income , gains , <br /> losses, other elements of investment return or contract value, and expenses shall be allocated <br /> as provided by a written procedure adopted by the Plan Administrator, which may be an <br /> agreement between the Plan Administrator and the Agent. <br /> 7. 5 No rights created by allocation <br /> Any allocation of Contributions or investment earnings to any Account shall not cause the <br /> Participant to have any right, title , or interest in any assets of the Plan, except as expressly <br /> provided by the Plan . <br /> 8 . Reemployment after Uniformed Service <br /> 8 . 1 Protection of persons who serve in a Uniformed Service <br /> To the extent required by 38 U . S . C . § 4318 , a person who is a member of, applies to be a <br /> member of, has perfornied, applies to perform, or has an obligation to perform service in a <br /> Uniformed Service shall not be denied any Deferred Compensation or right under this Plan <br /> on the basis of such membership , performance of service , application for service , or <br /> obligation. <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities, Inc. <br /> Page 31 <br /> 02,'01i2009 <br />
