Florida Municipal Pension Trust Fund <br /> 457( b) Deferred Compensation Plan <br /> 2 . Participating Employers <br /> 2 . 1 Adoption by Participating Employer <br /> A Participating Employer may make the Plan available to its Employees if it takes the <br /> following actions : <br /> a) The Governing Authority of the Participating Employer must pass an <br /> ordinance or resolution formally adopting this Plan for its Employees and <br /> approving the Adoption Agreement . <br /> b) The ordinance or resolution must indicate the date of adoption . <br /> c ) The ordinance or resolution must commit to the terms of an Adoption <br /> Agreement as completed by the Participating Employer . <br /> d) The ordinance or resolution must specify that the Participating Employer <br /> shall abide by the tenors of the Plan, including all investment, <br /> administrative , and service of the Plan, and all applicable provisions of the <br /> Code and other applicable law . <br /> e) The ordinance or resolution must acknowledge that the Master Trustee is <br /> only responsible for the Plan and have no responsibility for other <br /> employee benefit plans maintained by the Participating Employer. <br /> 2 . 2 Participating Employer has same provisions <br /> Except as properly specified by the Adoption Agreement, each Participating Employer <br /> adopts the Plan . The Participating Employer ' s adoption of the Plan is stated by the <br /> Adoption Agreement . <br /> 2 .3 Amendment binding upon all Participating Employers <br /> a) Subject to the provision of any applicable law , the Master Trustee may at any <br /> time amend or modify this Plan without the consent of the Participating <br /> Employers or of Participants ( or any Beneficiaries thereof) . Any <br /> modification , alteration , or amendment of the Plan, made in accordance with <br /> this Provision , may be made retroactively , if deemed necessary or appropriate <br /> by the Master Trustee . A copy of the resolution of the Master Trustee making <br /> such amendment shall be delivered to the Plan Administrator, and the Plan <br /> shall be amended in the manner and effective as of the date set forth in such <br /> resolution , and the Participating Employers , Employees , Participants , <br /> Beneficiaries , Master Trustee , and Plan Administrator shall be bound by the <br /> amendment . A Participating Employer may not amend the Plan in any way . <br /> b) Subject to the provisions of applicable law , the Master Trustee may at any <br /> time amended or modify the form of Adoption Agreement with the consent of <br /> the Participating Employers , unless otherwise required under Provision 2 . 4 . <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities, Inc . <br /> Page 4 <br /> 02, 01/_009 <br />
