Florida Municipal Pension Trust Fund <br /> 457(b) Deferred Compensation Plan <br /> redemptions or transfers by order, or during any period otherwise described by § 22 (e)( 1 )- (3 ) <br /> of the Investment Company Act of 1940, as amended [ 15 U . S . C . § 80a-22 (e)( 1 )-(3 )] . <br /> If the Participant received an allocation of Employer Contributions for a period that included <br /> his or her absence under a federal or state Family and Medical Leave Act, the Plan Sponsor <br /> shall delay payment of any Distribution until the Plan Sponsor is satisfied that the Participant <br /> has returned to work from such absence or that the Participant will not or did not return to <br /> work from such absence . <br /> 15. 8 Dispute as to proper recipient <br /> If a dispute arises as to the proper recipient of any payment( s ) under the Plan , the Plan <br /> Sponsor, in its sole discretion , may instruct the Issuer(s) to withhold payment until the <br /> dispute is determined by a court of competent jurisdiction or is settled by the parties <br /> concerned . <br /> 15 . 9 Doubt as to proper payee <br /> If the Plan Sponsor determines that there is doubt as to the proper construction of the Plan <br /> with respect to determining the Beneficiary( s) or other proper payee( s) under the Plan, <br /> the Plan Sponsor shall construe the Plan to state provisions consistent with the Uniform <br /> Probate Code applied as though the interest under the Plan were an interest to a <br /> commercial annuity contract, to the extent that any such construction is not inconsistent <br /> with any requirement of IRC § 457(b ) . <br /> 15 . 10 Distribution to minor Beneficiary <br /> If a Distribution is to be made to a minor Beneficiary , any payment( s) may, except to the <br /> extent prohibited by applicable law , be paid to a responsible person according to the <br /> following order : <br /> 0 as instructed by an appropriate court , <br /> • to the duly appointed and currently acting guardian or conservator of the <br /> Beneficiary , <br /> • to the custodial parent of the Beneficiary , <br /> • to a responsible adult with whom the Beneficiary maintains his or her residence , <br /> • to a responsible adult who is a relative of the Beneficiary , <br /> • to a Master Trustee for the Beneficiary under the Uniform Transfers to Minors Act or <br /> Uniform Gifts to Minors Act, <br /> • to the court having jurisdiction over the estate of the Beneficiary , <br /> 9 to any person determined by the Plan Sponsor to be a proper recipient for the <br /> Beneficiary . <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities, Inc . <br /> Page 43 <br /> 02.01 /2009 <br />
