Florida Municipal Pension Trust Fund <br /> 457(b) Deferred Compensation Plan <br /> incompetent, the person who is a proper recipient for a Participant or Beneficiary who is a <br /> minor or an incompetent, whether any power-of- attorney is effective and acceptable to act <br /> with respect to the Plan , whether a Signature Guarantee is required, whether a Signature <br /> Guarantee is acceptable for any purpose under the Plan . <br /> 16.3 Determinations to be uniformly made <br /> To the extent necessary to avoid discrimination prohibited by any employment law, any <br /> determination or decision required or permitted to be made for the purposes of the Plan by <br /> the Plan Sponsor shall be uniformly and consistently made according to reasonable <br /> procedures established and maintained by the Plan Sponsor. <br /> 16 .4 Plan Administrator is responsible <br /> The Plan Administrator is responsible for performing all duties agreed to regarding the <br /> operation of the Plan, and is responsible for supervising the performance of any other <br /> persons who may assist in the performance of the Plan Administrator' s responsibilities . The <br /> Plan Administrator does not have the authority or discretion to perform activities or decide <br /> any matter or question not provided for under the Plan, such as , but not limited to , forefieture <br /> of retirement benefits determinations under Section 112 . 3 173 , Florida Statutes, and any such <br /> activities or decisions shall be the sole responsibility of the Plan Sponsor. <br /> 16. 5 Information from Participating Employer <br /> To enable the Plan Administrator to perform its responsibilities , the Participating <br /> Employer(s) shall promptly provide to the Plan Administrator complete and accurate <br /> information on any matter under the Plan . The Plan Administrator shall rely upon this <br /> information as supplied by the Participating Employer, and shall have no duty or <br /> responsibility to verify this information . <br /> 16. 6 Plan Administrator may delegate or contract <br /> Except as prohibited by the Enabling Statute or other State law , the Plan Administrator <br /> may , except when expressly prohibited by this Plan, delegate any of its duties to any <br /> Participating Employer, or to any officers , employees , or agents of any kind . Except as <br /> prohibited by the Enabling Statute or other State law, the Plan Administrator may , except <br /> when expressly prohibited by this Plan , contract any of its duties to the Agent or <br /> otherwise . <br /> 16 . 7 Plan services <br /> The Plan Administrator may contract with any person to provide services to assist in the <br /> administration of the Plan . The Plan Administrator must make such contracts in compliance <br /> with the Enabling Statute and other applicable State law . <br /> Any person other than the Plan Administrator who performs services regarding the Plan <br /> (including but not limited to the Agent ) is subject to the supervision and direction of the <br /> Plan Administrator, and does not have authority to control the operation of the Plan . <br /> Florida Municipal Pension Trust Fund <br /> Florida League of Cities , Inc . <br /> Page 47 <br /> o2/olizoo9 <br />
