NEER . ENGINEER will promptly review the B . Limited Reliance by CONTRACTOR on <br /> Underground Facility and determine the extent, Technical Data Authorized: CONTRACTOR may rely <br /> if any, to which a change is required in the upon the general accuracy of the "technical data" <br /> Contract Documents to reflect and document contained in such reports and drawings , but such <br /> the consequences of the existence or location reports and drawings are not Contract Documents , <br /> of the Underground Facility . During such time , Such "technical data" is identified in the <br /> CONTRACTOR shall be responsible for the Supplementary Conditions . Except for such reliance <br /> safety and protection of such Underground on such "technical data , " CONTRACTOR may not rely <br /> Facility. upon or make any Claim against OWNER , <br /> ENGINEER or any of ENGINEER 's Consultants with <br /> 2 . If ENGINEER concludes that a respect to: <br /> change in the Contract Documents is required , <br /> a Work Change Directive or a Change Order 1 . the completeness of such reports <br /> will be issued to reflect and document such and drawings for CONTRACTOR ' s purposes, <br /> consequences . An equitable adjustment shall including , but not limited to , any aspects of the <br /> be made in the Contract Price or Contract means , methods , techniques , sequences and <br /> Times , or both , to the extent that they are procedures of construction to be employed by <br /> attributable to the existence or location of any CONTRACTOR and safety precautions and <br /> Underground Facility that was not shown or programs incident thereto ; or <br /> indicated or not shown or indicated with <br /> reasonable accuracy in the Contract 2 , other data , interpretations, opinions <br /> Documents and that CONTRACTOR did not and information contained in such reports or <br /> know of and could not reasonably have been shown or indicated in such drawings ; or <br /> expected to be aware of or to have anticipated . <br /> If OWNER and CONTRACTOR are unable to 3 . any CONTRACTOR interpretation of <br /> agree on entitlement to or on the amount or or conclusion drawn from any "technical data" <br /> extent, if any, of any such adjustment in or any such other data , interpretations , opinions <br /> Contract Price or Contract Times, OWNER or or information . <br /> CONTRACTOR may make a Claim therefor as <br /> provided in paragraph 10 . 05 . C . CONTRACTOR shall not be responsible for <br /> any Hazardous Environmental Condition uncovered or <br /> 4 . 05 Reference Points revealed at the Site which was not shown or indicated <br /> in Drawings or Specifications or identified in the <br /> A. OWNER shall provide engineering surreys to Contract Documents to be within the scope of the <br /> establish reference points for construction which in Work . CONTRACTOR shall be responsible for a <br /> ENGINEER' s judgment are necessary to enable Hazardous Environmental Condition created with any <br /> CONTRACTOR to proceed with the Work . CON- materials brought to the Site by CONTRACTOR , <br /> TRACTOR shall be responsible for laying out the Subcontractors , Suppliers , or anyone else for whom <br /> Work , shall protect and preserve the established CONTRACTOR is responsible, <br /> reference points and property monuments , and shall <br /> make no changes or relocations without the prior D . CONTRACTOR shall Environmental Condition or if CONTRACTOR or <br /> report to ENGINEER whenever any reference point or anyone for whom CONTRACTOR is responsible <br /> property monument is lost or destroyed or requires creates a Hazardous Environmental Condition , <br /> relocation because of necessary changes in grades or CONTRACTOR shall immediately: ( i) secure or <br /> locations , and shall be responsible for the accurate otherwise isolate such condition ; (ii) stop all <br /> Work in <br /> replacement or relocation of such reference points or connection with such condition and in any area <br /> property monuments by professionally qualified affected thereby (except in an emergency as required <br /> personnel , by paragraph 6 . 16) ; and ( iii ) notify OWNER and ENGI . <br /> NEER (and promptly thereafter confirm such notice in <br /> 4 . 06 Hazardous Environmental Condition at Site writing ) . OWNER shall promptly consult with <br /> ENGINEER concerning the necessity for OWNER to <br /> A. Reports and Drawings: Reference is made to retain a qualified expert to evaluate such condition or <br /> the Supplementary Conditions for the identification of take corrective action , if any . <br /> those reports and drawings relating to a Hazardous <br /> Environmental Condition identified at the Site , if any , E .
