K, 13Ai{ 1t) i't , CLFI ; <br /> remove such title exceptions shall not impose an obligation upon Seller to remove those exceptions , Buyer <br /> acknowledges that Seller' s title to the Property may be subject to court approval of a foreclosure action , <br /> result of a like or similar action , i . e. deed in lieu or as part of a purchase from a prior servicer, or to a <br /> mortgagor 's right of redemption. <br /> 9 , NORM OF DEED : The deed to be delivered at closing shall be a deed that covenants that grantor grants only <br /> that title which grantor may have and that grantor will only defend title against persons claiming by, through, or <br /> under the grantor, but not otherwise (which deed may be known as a Special Warranty, Limited Warranty , Quit <br /> Claim or Bargain and Sale Deed) . <br /> 10 . SELLER DISCLOSURE ; BUYER PURCHASING THE PROPERTY " AS IS " : <br /> a . Buyer understands that Seiler has never lived in or on the Property . The Property is being sold and <br /> purchased in "as is - where is condition without representations and warranties" expressed or implied . <br /> Buyer acknowledges that this Property was acquired by foreclosure, deed in lieu of foreclosure, or the <br /> purchase of a REO of the former mortgage/tender and may be exempt from certain state requirements <br /> regarding delivery of a state mandated Real Estate Transfer Disclosure Statement. Buyer acknowledges that <br /> they are not relying on any representations , statements, guarantees or warranties of any kind including, <br /> without limitation, the physical condition of the property and any improvements located thereon, or their <br /> suitability for any particular purpose or of merchantability , Buyer shall rely on its own investigations of the <br /> property in determining whether to acquire it. The provisions of this paragraph are a material part of the <br /> consideration for seller entering into this Addendum, and shall survive closing. <br /> b. if there is an enforcement proceeding arising from allegations of such violations before an enforcement <br /> board, special master, court of competent jurisdiction or similar enforcement body, and neither Buyer nor <br /> Seller terminate the Addendum, Buyer agrees to : <br /> i . To accept the Property subject to the violations, AND <br /> ii . Be responsible for compliance with the applicable code or regulation and with orders issued in any <br /> code enforcement proceeding, AND <br /> iii . Resolve the deficiencies as soon as possible after the closing and funding, AND <br /> iv . Buyer further agrees to indemnify Seller from all claims or liability arising fi•onn Buyer ' s breach of <br /> this section, <br /> c . Buyer hereby acknowledges that Seller may not be providing Buyer with a Real Estate Disclosure Statement <br /> and/or Certificate of Occupancy with respect to the Property . Buyer hereby waives any requirement that <br /> Seller ftn•nished Buyer with any such disclosure statement and/or a Certificate of Occupancy and hereby <br /> releases Seller from all liability resulting from tine non- delivery of such disclosure statement and/or <br /> Certificate of Occupancy where applicable. <br /> d . Buyer acknowledges that no personal property is included as part of the transaction unless expressly included <br /> in the Addendum. Buyer assumes finll responsibility for any Personal Property remaining ori the Property at <br /> the time of closing and funding and Personal Property sold by Seller shall be accepted by Buyer on an "as is , <br /> where is" basis without representation or warranty of any kind or nature, and specifically excluding any <br /> warranties of merchantability or fitness for any particular purpose. <br /> 11 . LEAD BASED PAINT AND LEAD BASED HAZARADS FOR PRE4978 PROPERTIES : Every purchaser of any <br /> interest in residential real property on which a residential dwelling was built prior to 1978 is notified that such <br /> property may present exposure to lead from lead-based paint that may place young children at risk of developing <br /> lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including <br /> learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning <br /> also poses a particular risk to pregnant women . The seller of any interest in residential real property is required <br /> to provide the buyer with any information on lead-based paint hazards from risk assessments or inspections in the <br /> seller' s possession and notify the buyer of any known lead-based paint hazards .
