f <br /> o. o / jq ' J <br /> BOAT CLUB ISLAND (SPOIL ISLAND IR 25) <br /> AGREEMENT FOR IMPROVEMENT AND MAINTENANCE OF BOAT <br /> CLUB ISLAND <br /> THIS AGREEMENT is entered into this 11th day of June , 2013 , by and <br /> between Indian River County, a political subdivision of the State of Florida, 1801 27th Street, <br /> Vero Beach, FL 32960 ("County') and Grand Harbor Community Association, Inc., a Florida <br /> non-profit corporation, 4755 South Harbor Drive, Vero Beach, FL 32967 ("Association"). <br /> WHEREAS, on or about March 29, 2010, the County entered into a Sovereignty <br /> Submerged Lands Lease ("State Lease') with the Board of Trustees of the Internal Improvement <br /> Trust Fund of the State of Florida, for use of the southern portion of Spoil Island IR-25, known <br /> locally as "Boat Club Island ("South IR-25'1, a copy of which is attached hereto as Exhibit As <br /> and <br /> WHEREAS, the Association has offered to enter into an arrangement with the County mi <br /> which the County and the Association will share the cost of certain improvements on South IR- <br /> 25, and the Association will provide volunteer services to clean up and maintain South IR-25, all <br /> as set forth more fully herein; and <br /> WHEREAS, the County desires to accept the Association' s offer, recognizing that the <br /> arrangement will result in a public — private cooperative effort which will benefit, and provide <br /> increased recreational opportunities for, the residents of and visitors to Indian River County, <br /> NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency <br /> of which is hereby acknowledged, the parties hereby agree as follows. <br /> 1 . RECITALS. The above recitals are true and correct, and are incorporated herein. <br /> 2. DOCKS. The parties shall confer and develop a plan to repair the southernmost <br /> dock on South IR-25 to a condition which is suitable for public use, and to remove the remaining <br /> two docks which are currently in a state of disrepair. Upon development of a mutually <br /> acceptable plan, and receipt of a mutually acceptable proposal for construction services, the <br /> County shall (a) apply for a grant from the Florida Inland Navigation District ("FIND"), which <br /> grant amount is estimated to be in the amount of $7,500, and (b) ' apply for any permits (other <br /> than a building permit) which may be necessary to implement the plan. Upon receipt of the <br /> FIND grant and required permits, the County shall enter into an agreement for construction <br /> services with a qualified contractor. The cost of the construction services shall be paid first with <br /> the FIND grant funds, and the remaining balance shall be paid 50% by the 'County and 50% by <br /> the Association. <br /> Page 1 of 3 <br />
