7-Z• 13 <br /> AMENDED AND RE -STATED AGREEMENT BETWEEN <br /> Indian River County [ Grantee ] <br /> AND <br /> Indian River Habitat for Humanity [ Developer] <br /> FOR THE <br /> Neighborhood Stabilization Program 3 ( NSP3 ) <br /> THIS Amended and Re-stated Agreement, is entered this 2nd day of July, 2013 by and between <br /> the NSP3 Grantee of Indian River County ( herein called "Grantee" ) and Indian River Habitat for <br /> Humanity ( herein called " Developer" ) . <br /> WHEREAS, Grantee was awarded a Neighborhood Stabilization Program 3 Community <br /> Development Block Grant ( CDBG ) (Contract #B- 11- UN- 12 -0022 ) from the U .S. Department of Housing <br /> and Urban Development ( HUD), which provides for the purchase, rehabilitation, administration, and sale <br /> of foreclosed properties to eligible very low, low and moderate income families, and <br /> WHEREAS, on August 16, 2011 Grantee entered into an Agreement with Developer to carry out <br /> specific activities within Grantee's NSP3 contract with HUD in accordance with applicable notices, <br /> regulations and guidance from HUD; and <br /> WHEREAS, Grantee and Developer mutually agree to significant changes to the August 16, 2011 <br /> Agreement; <br /> NOW, THEREFORE, in consideration of the mutual promises and covenants, the parties agree to the <br /> following Amended and Re-stated Agreement. <br /> I . SCOPE OF SERVICE <br /> Developer will be responsible for carrying out NSP3 activities in a manner satisfactory to Grantee and <br /> consistent with all standards required as a condition of providing these funds. Program activities will <br /> include the following uses and corresponding activities eligible under NSP3 : <br /> A. Developer Responsibilities <br /> 1 . This program activity involves the acquisition and development <br /> ( rehabilitation ) of residential property that has been foreclosed upon or abandoned, is <br /> blighted or is vacant in accordance with the definitions and requirements of the NSP3 <br /> program, to the extent that these activities are incorporated in this Section I and in <br /> Exhibiti A. <br /> 1 I Page Amended and Re-stated NSP3 Developer Agreement : July 2 , 2013 <br /> r <br />
