O JGINAIL <br /> Exhoibft " C " <br /> Addendum To Hefflebower Agreement To Purchase , Sell , and Lease Real Estate <br /> ( Paragraph 8 . 12 ) <br /> 1 ) The County will pay $ 35 , 000 for the proposed right- of-way and the easements . <br /> 2) In addition to the purchase price for the land the County will pay the <br /> Hefflebowers , at closing , $ 35 , 000 to re-establish a landscape buffer. This will <br /> include all trees moved , landscaping and any fence relocation . <br /> 3 ) The right-of-way will be sodded with the same grass as around the house ( not <br /> seeded ) up to the pavement . <br /> 4 ) The County will go to reasonable effort to ensure that the 2 large <br /> Oaks on the proposed right-of-way line are not removed or harmed during <br /> construction . At such time the 2 large Oaks become unhealthy a 10 day notice <br /> will be provided to the Hefflebowers before removal . <br /> 5 ) Survey stakes shall be re- posted in their correct locations <br /> 6 ) There shall be no storage of the road contractor' s construction equipment on the <br /> parcel acquired from the Hefflebowers . <br /> 7 ) So that the Hefflebowers retain the ability to build on the remainder if they chose <br /> to sell their property in two lots ( one legal , conforming 5 acre lot and one legal , <br /> non -conforming 4 . 5 acre lot) , the County will grant the Hefflebowers a one time <br /> lot split and waive the fees for said one time lot split . The one time lot split shall <br /> be performed when the Hefflebowers deem it appropriate with no or reasonable <br /> limitations on when the lot split can be performed . <br /> 8 ) The catch basin and equivalent drainage shall be restored . The sufficiency of <br /> the restored drainage shall be determined by a County engineer , so as to ensure <br /> that the property remains connected to the public surface water drainage <br /> system . The Hefflebowers retain the right to hire an engineer to review the <br /> County ' s assessment of the restored drainage at the County ' s expense . <br /> 9 ) The County agrees to pay legal fees to Mickey Barkett in the amount of $ 13 , 000 . <br /> 7 <br />
