IA <br /> L If Al <br /> 10( <br /> Indian River County Holman Stadium Use Agreement <br /> This Holman Stadium Use Agreement ("Agreement") is made this 20th day <br /> Of December 20111 by and between Indian River County Board of County <br /> Commissioners , a political subdivision of the State of Florida ( " County") and The Youth <br /> Guidance Donation Fund of Indian River County , Inc . (" User Group ") . <br /> BACKGROUND RECITALS <br /> A . The User Group has requested the use of Holman Stadium facilities (collectively <br /> referenced as " Stadium ") under the terms and conditions set forth in the Indian <br /> River County Holman Stadium Use Guidelines , attached to this Agreement as <br /> Exhibit 1 and incorporated herein in its entirety by this reference and under the <br /> terms and conditions set forth in this Agreement . <br /> B . The County will allow the User Group to use the Stadium under the terms and <br /> conditions set forth in Exhibit 1 and under the terms and conditions set forth in <br /> this Agreement . <br /> NOW THEREFORE , for good and valuable consideration , the receipt and sufficiency of <br /> which is hereby acknowledged , and intending to be legally bound , the parties agree as <br /> follows : <br /> 1 . PERIOD OF USE . This Agreement shall be in force February 11 , 2012 , and <br /> includes all setup and clean up time . <br /> 2 . NUMBER OF PARTICIPANTS EXPECTED . User Group estimates that the <br /> number of participants expected at the event is from 500 up to seating capacity of <br /> 6 , 500 . <br /> 3 . DESCRIPTION OF EVENT . User Group states that the following is an accurate <br /> description of the event : a fundraising event called "The Heli- Drop Ball Bash and BBQ " . <br /> The event will begin at 4 : 30p with a City v . County Kickball game on the baseball field <br /> . <br /> The kickball game will be followed by the dropping from a helicopter (close to ground <br /> level , by 2nd base or in the outfield ) onto the empty baseball field of 750 numbered pre,,, <br /> sold golf balls . The 6 closest balls to the target (target TBD by Holman Stadium official , <br /> helicopter pilot and Youth Guidance Executive Director) , will win a combined total of <br /> $ 10 , 000 in cash prizes ( $ 5000 ball closest , $2500 ball 2nd closest , $ 1000 third closest , <br /> $ 500 4 -6th closest . ) Guests will move to park- like/parking area at Holman Stadium <br /> located just east of the " new" office building for a Bono ' s BBQ dinner and a band until <br /> 10p . ( Event Flyer attached ) . The helicopter dropping of balls are well known around the <br /> country and are safe . Fundraisers who use this method can be provided as well as on - <br /> line video footage of such drops in the event there may be any safety concerns ) . <br /> 4 . INSURANCE . The minimum dollar amounts and types of insurance coverages <br /> required are set forth in Exhibit 2 attached hereto and incorporated herein in its entirety <br /> by this reference . Youth Guidance does have its own comprehensive liability insurance <br /> coverage (also attached ) . <br /> 1 <br />
