The Lead-Based Paint Poisoning Prevention Act (42 U.S .C. 4821 1846), the Residential Lead. <br /> Based Paint Hazard Reduction Act of 1992 (42 U.S .C. 4851 -4856), and implementing regulations at 24 CFR part <br /> 35 , subparts A, B , H, J, K, M, and R apply to activities under this program, <br /> (g) Audit. Recipients and subrecipients must comply with the audit requirements of OMB Circular A-133, "Audits <br /> of States, Local Governments, and Non-profit Organizations." <br /> (h) Davis-Bacon Act. The provisions of the Davis-Bacon Act do not apply to this program. <br /> (i) Section 3 of the Housing and Urban Development Act. Recipients and subrecipients must, as applicable, comply <br /> with Section 3 of the Housing and Urban Development Act of 1968 and its implementing regulations at 24 CFR part <br /> 135, as applicable. <br /> Subpart G—Grant Administration <br /> § 578. 101 Technical assistance. <br /> (a) Purpose. The purpose of Continuum of Care technical assistance is to increase the effectiveness with which <br /> Continuums of Care, eligible applicants, recipients, subrecipients; and UFAs implement and administer their <br /> Continuum of Care planning process; improve their capacity to prepare applications, prevent the separation of <br /> families in projects funded under the Emergency Solutions Grants, Continuum of Care, and Rural Housing Stability <br /> Assistance programs; and adopt and provide best practices in housing and services for persons experiencing <br /> homelessness. <br /> (b) Defined Technical assistance means the transfer of skills and knowledge to entities that may .need, but do not <br /> possess, such skills and knowledge. The assistance may include, but is not limited to, written information such as <br /> papers, manuals, guides, and brochures; person-to-person exchanges; web-based curriculums, training and <br /> Webinars, and their costs. <br /> (c) Set-aside. HUD may set aside funds annually to provide technical assistance, either directly by HUD staff or <br /> indirectly through third-party providers. <br /> (d) Awards. From time to time, as HUD determines the need, HUD may advertise and competitively select providers <br /> to deliver technical assistance. HUD may enter into contracts, grants, or cooperative agreements, when necessary, to <br /> ` implement the technical assistance. HUD may also enter into agreements with other federal agencies for awarding <br /> the technical assistance funds. <br /> § 578. 103 Recordkeeping requirements. <br /> (a) In general. The recipient and its subrecipients must establish and maintain standard operating procedures for <br /> ensuring that Continuum of Care program funds are used in accordance with the requirements of this part and must <br /> establish and maintain sufficient records to enable HUD to determine whether4the recipient and its subrecipients are <br /> meeting the requirements of this part, including: <br /> ( 1 ) Continuum of Care records. Each collaborative applicant must keep the following documentation related to <br /> establishing and operating a Continuum of Care: <br /> (i) Evidence that the Board selected by the Continuum of Care meets the requirements of §578.5(b); <br />
