I. <br />Page 2 <br />4 <br />C <br />1. The First Party shall construct anew radio tower, which.,shall be <br />174 feet above sea leveli upon plans and specifications to be submitted by <br />the Second Party, and this Agreement shall be subject -to the First Party <br />securing permission from the F..A.A. for the erection of the tower and <br />I <br />i` subject to the Second Party securing F. C. C. approval of the location as a <br />transmitter site for the Second Party. The tower shall be erected within <br />sixty (60) days after the approval by F. A.A. and F. C. C. , and tower shall <br />+ remain the property of First Party. <br />l <br />• <br />2. The Second Party agrees to reimburse the First Party for all of his <br />costs in the installation and erection of the new. 174 -foot radio tower for the <br />right of the Second Party to install, its antenna on said tower for 'its radio <br />broadcasting. <br />There shall be no other sums to be paid by the Second..Party' other than <br />the complete reimbursement of the .cost of a new radio broadcasting tower. <br />3. First Party also grants to the Second Party, in addition to the right <br />to install his broadcasting equipment, the ground right to construct an 8' x 8' <br />concrete block building at Second Party's expenses for the housing of 'its radio <br />receiving and/or transmitting equipment for the transmitting and receiving of <br />signals for its broadcasting station, 'together with the right of ingress and <br />egress from the nearest public road to the 8' x 8' building and/or to the radio. <br />tower for necessary repairs, maintenance, and operation of its equipment. <br />The First Party shall have the right to,place its broadcasting equipment in said <br />building provided that its installation shall not interfere with any equipment <br />used by Second Party in its radio broadcasting.. <br />4.
