Under no circumstances shall any person, firm, <br />59 <br />corporation or partnership operate any festival which will continue for <br />., . <br />60 <br />6'x <br />more than one eight (8) hour period without a twenty-four (24) hour rest <br />61 . <br />period before any continuation of the festival., <br />62 <br />Section 6. No child under the age of 17 years shall, be <br />63 <br />admitted to any festival unless he is accompanied by his parent or <br />64 <br />guardian, Said parent or guardian shallremain with the child at all <br />65 <br />times. <br />.66 <br />Section 7. The Board may assess a reasonable fee for the <br />67 <br />issuance of the permit provided in Section 3. <br />68 <br />Section 8. Anyone who violates any section of this ordinance <br />69 <br />shall be prosecuted by the prosecuting officer in Indian River County <br />f <br />70 <br />having authority to prosecute misdemeanors and, upon conviction, shall <br />71.. <br />be punished by fine not to exceed $500.00 or by ,imprisonment in the <br />72 <br />county jail not to exceed sixty (60) days or by both such fine and imprison- <br />?3 <br />ment. Each violation shall constitute a separate offense. The Board may <br />74 <br />bring suit to restrain, enjoin, or otherwise prevent Violation of this <br />• <br />.75 <br />ordinance in the Circuit Court of Indian River County. <br />'- <br />.76 <br />Section 9. It is .declared ,to be the intent of the Board that if <br />` <br />77 <br />any section,. subsection, sentence, clause, phrase or portion of this <br />78 <br />ordinance • is for any reason held invalid or unconstitutional by any court <br />79 <br />of competent jurisdiction, such portion shall be deemed a separate, distinct <br />80 <br />and independent provision, and such holding shall not affect the validity <br />' <br />81 <br />of the remaining portions hereof. <br />82 <br />Section 10, The provisions of this ordinance shall be <br />83 <br />liberally construed in order to effectively carry out the purposes, of <br />J U L 2 2 1970 <br />
