� ti �c�tivrk �o <br /> MEMORANDUM OF AGREEMENT <br /> This Agreement is entered into by Indian River County Board of County Commissioners , "the <br /> County", and International Association of Firefighters , Local 2201 , "the Union . " <br /> As a showing of solidarity in the face of extremely challenging economic times, the County and the <br /> Union mutually agree to the following terms and conditions set forth below : <br /> • Bargaining unit employees will not receive step increases or lump sum payments for FY <br /> 2010/2011 as listed in Article 34 . 02 A . of the collective bargaining agreement. Additionally, <br /> the Union will not demand to bargain for a cost- of- living increase for FY 2010/2011 as outlined <br /> in the same article/section . <br /> • If general , non-bargaining unit employees , under the purview of the County Administrator, <br /> receive a cost- of- living increase, anniversary/merit increase, or lump sum anniversary payment <br /> for FY 2010/2011 , then bargaining unit employees will receive their step increase or lump sum <br /> payment for FY 2010/2011 in accordance with the current collective bargaining agreement . <br /> • The collective bargaining agreement is effectively extended through September 30 , 2013 . Pay <br /> increases listed in Article 34 . 02 A . (specifically, step increases and lump sum payments) shall <br /> be reinstated for FY 2011 /2012 and FY 2012/2013 contingent upon the following conditions : <br /> For FY 2011 /2012 : <br /> 1 . Property values increase by 3 . 25 % (or greater) than the certified taxable value as established <br /> by the Property Appraiser ' s office on June 29 , 2010 ; and/or <br /> 2 . The Emergency Services District unreserved fund balance increases by $ 430 , 000 or more <br /> from the FY 2009/2010 ending unreserved fund balance during FY 2010/2011 based upon <br /> no increase from the current millage rate of 1 . 7148 ; and/or <br /> 3 . Any employee, under the purview of the County Administrator, including the County <br /> Administrator, receives an anniversary/merit increase or lump sum anniversary payment . <br /> For FY 201. 2/2013 : <br /> 1 . Property values increase by 3 . 25 % (or greater) than the certified taxable value as established <br /> by the Property Appraiser ' s office on June 29 , 2010 or <br /> 2 . The Emergency Services District unreserved fund balance increases by $ 430 , 000 or more <br /> from the FY 201. 0/2011 ending unreserved fund balance during FY 2011 /2012 based upon <br /> no increase from the current millage rate of 1 . 7148 ; and/or <br /> 3 . Any employee , under the purview of the County Administrator, including the County <br /> Administrator, receives an anniversary/merit increase or lump sum anniversary payment . <br /> In the event the aforementioned conditions are not met, the Union agrees to forgo step increases <br /> and lump sum payments for FY 2011 /2012 and/or FY 2012/2013 , respectively, as listed in <br /> Article 34 . 02 A . of the collective bargaining agreement . Any step moves or lump sum <br /> payments after the expiration of this Memorandum of Agreement and extension of the collective <br /> bargaining agreement shall be subject to collective bargaining . No " status quo " rights to cost- <br />
