<br /> PUBLIC UTILITY EASEMENT
<br /> THIS PUBLIC UTILITY EASEMENT , made and executed this day of
<br /> MAY , 2011 ) by SASSON KASSAB and REGINA KASSAB , Trustees of the
<br /> Sasson Kassab Living Trust dated August 5 , 2009 , and any amendment thereto , whose
<br /> address is 36 NE First Street, Suite 211 , Miami , FL 33132 , hereinafter called " Grantor", to
<br /> INDIAN RIVER COUNTY , FLORIDA , hereinafter called " Grantee" .
<br /> (Wherever used herein the term Grantor and Grantee include all pOarties to this instrument and their heirs, legal
<br /> representatives, successors , and assigns)
<br /> WITNESSETH :
<br /> That Grantor for and in consideration of the sum of One Dollar and other consideration,
<br /> receipt of which is hereby acknowledged , does hereby grant, bargain sell , alien, remise , release ,
<br /> convey, and confirm unto Grantee an easement for Public Utilities including, but not limited to ,
<br /> natural gas along, over , across , and beneath the following described land , situate in Indian River
<br /> County, Florida, to -wit :
<br /> The West 25 feet of Tract 7 lying north of the North right of way of State Road
<br /> 60 , in Section 1 , Township 33 South, Range 38 East, according to the last general
<br /> plat of lands of the Indian River Farms Company Subdivision, as recorded in Plat
<br /> Book 1 , Page 25 , of the Public Records of St . Lucie County, Florida; said lands
<br /> now lying and being in Indian River County, Florida .
<br /> Grantor hereby reserves the right of ingress and egress over, upon, and across the
<br /> easement parcel herein described, for the Grantor, and Grantor ' s successors , assigns , Lessees ,
<br /> Licensees , and invitees . Grantor further reserves the right to construct a roadway over the
<br /> easement parcel , or portion thereof, for the passage of vehicular and pedestrian traffic .
<br /> And Grantor hereby covenants with said Grantee that it is lawfully seized of said servient
<br /> land in fee simple , and that it has good right and lawful authority to convey the easement
<br /> established hereby, subject to mortgages and other encumbrances or restrictions of record .
